Hello,I just had a quick question, you reference an enclosure to include with your debt validation letter, but I'm a little confused after reading said enclosure.Your DV letter states that you are requesting not a verification but a validation, only the enclosure references a verification. I'm just concerned including the enclosure referencing verification, along with a request for validation would be somewhat contradicting myself. Please advise if at all possible, thank you!

Yes my loan was with cashnet usa. I called them and send they sold it to AIS, but NCA called me and they were collecting for cashnetusa. They said I owed $950 and that I had to make it in two payments. I told them I couldn't and tried to work some other plan and in the middle of the conversation he said you know what just forget about it like he kept saying I refused to pay very rude.
I noticed that you replied to Perry968 on the Frederick Kelly matter. He states that he is not licensed to practice law or collect in Mn. How would I find out if he is licensed to do so in my state?
I would do as uncle wulf suggested. See if it can be mailed to you or you can do anything online. That is a long drive to make, see if you can find a way around it first.
I know normally a writ of execution might be able to do this. However in some states it is not legal to do so as some types of personal property are exempt. I don't think so in Texas, but you should check your state law just to be sure.

However they cannot force the sale of property. Some states will not even allow liens to be placed on property. Saying they will take your son away from you? I think you can take them to court over that, the statutory damages is only $1,000 but I heard of a woman that was threatened by a collection agency, she was told that she would be sent to jail and since she was such a deadbeat mom that her children would be taken away from her. She got $1,000 in statutory damages, however she received $146,000 in punitive damages (mental anguish, etc.)

Yes to both!I noticed an increase back to what it used to be. It had slowed for a while. I think some is from members that left disgruntled or were barred also.
Just let them know that you would like the information, and that you'd like to know what you are paying and to whom and would like that documentation. I would suggest not paying it until they give you the validation. That way you know your not getting scammed.

The department I work in doesn't buy the debt. In fact the stuff I do work isn't even charged off. I don't think they buy a lot of debt anymore but I would assume, or hope, that anything they did buy would also come with the documentation to back it up or know where to get that information.As far as my division I know that we forward debt validation request to the creditor and the creditor mails them about 6 months worth of statements.

I know it doesn't sound very threatening...and I'm glad recovery should be easy. But I also ned some teeth replaced which they wouldn't or couldn't do till after this surgery and the pain has been idfficult at times...I don't mind the not eating part..LOL..I have actually lost 6 lbs. even though it's not the best way ..
Actually it is oral surgery...I have to have something something plasty done (I forgot what it's called) I can no longer bite down or chew..my jaw is out of alignment (tmj) which adds to the problem. It can be very painful at times not including the fact that it is very difficult to eat..kind of embarrassing since it is not life or death this time arouond for me...but still it makes my life difficult I seem to have a very low tolerance for pain.
