They have been calling my parents home for months now and even though my parents give them my phone number, they still harass them! I have called them and told them to stop calling my elderly parents and they won't! I have tried to get negotiate a payment plan and they won't accept it as "THAT WON'T EVEN COVER THE INTEREST CHARGES" They want me to send them $700 a month for a $5000 debt. That's ridiculous! I'm selling my car and having a huge garage sale to try to get them off my back, because I'm sick and tired of them harassing my parents.

I owe a legitimate debt. I get 6 - 8 calls PER DAY by at least two different people from ACS, even when making payments. I have repeatedly asked not to be called at work. The calls stop for awhile and then resume. My co-workers have been accused of being me and lying to ACS (I think their "legitimate" way of "accidently" humiliating me by disclosing my business"). My credit is already messed up and bugging the crap out of me isn't making me warm and fuzzy to pay. I tried to make payment arrangements (again) with ACS today and they were not satisfied with what I was able to do (I offered $200/month - a big stretch right now - he wants $1000/month - if I could pay that I would not be in collections). I told him I was considering bankruptcy and he said he was looking at my credit report and didn't think I was that "kind of peron" since I had more paid then open accounts. I told him I didn't want to but I would if I continued to be harrassed (I paid $750 last week to them). He said that would be stupid as it would cost like $1500 bucks (I owe $17k - isn't $1500 cheaper...?) I am not a deadbeat, unexpected circumstances put me in this situation. I went from "perfect credit" to crappy credit in two years. Perhaps if companies like Citibank were more willing to work with their customers in the bad times as well as the good times, they could keep their own money and continue to have loyal customers. I tried to work with Citibank and they were just as bad as ACS. They added BS interest and penalties faster than I could pay off the debt, so why would anyone expect them to have a collection agency who acts any differently? If Citibank had been willing to work with me, I am confident this debt would be at least 25% paid off and we would both be happy. Instead honest people like myself look for ways to dodge the calls and ultimately get out of paying the debt because companies like ACS make it so difficult to "want" to pay the debt and still keep a little dignity and humility as well. I am at th point where it would be far easier to file bankruptcy, take my lumps (I'm taking them anyway) and move forward then deal with this every day. I just made what I think is a significant payment and the calls didn't even stop for a week, why did I bother? A ten year blemish is still probably shorter than dealing with this collection agency for 2 or three years, paying off the debt and still having bad credit. Now how is that for inspiration to want to pay my debts? I use to think bankruptcy was a terrible thing for desperate people....count me in I guess.

The only reason you front like a **** is cuz ur on a phone. Your gonna piss yourself when were talking on ur door step. Your words will change as u start to piss urself. This is sugar coated. I think ill now use the money that would pay my debt on gas for me and sum cojo's up the block. Any good eats along the way? Were gonna be hungry. But whatchu know about hungry? Which house should i visit Jan? I guess I have time to check both while visiting Yardley.

Academy Collection started calling this week on a 90 day past due Citi card.

The following is a template for a validation-letter based on the letter I sent to Academy. I drafted it to cover most of the communications related provisions of the fdcpa.

2. We will contact the original creditor to resolve this matter, and we will pay the entire amount owed on this debt to the original creditor, and to the original creditor only;

b. To notify us that you or the original creditor may invoke remedies that are ordinarily invoked by you or the original creditor; or
c. To notify us that you or the original creditor intends to invoke a remedy.

I just rec'd a call from this number. No, my name is not Jamie, no I am not lying, and no, you can't do anything about it. Do not call me again if you are not willing to accept my answers as factual.

BTW, stop berating your collectees; if it weren't for their bad debt and worse attitudes, collectors would be out of business!

Have a lovely day.

Signed,
Free-to-be Debt-free

You are directing your comments to a debt forum which accomplishes absolutely nothing.

I got a letter a few days ago regarding my fathers account that went to ACS. Originally the account was under Plaza Associates in NY. I fell behind 2 payments and now they transfer it. Plaza Associate originally offered a settle amount of 4000.00 from 8000.00. Since the account now went to ACS, they wrote in the letter that they are offering a settle amount of 6186.00. Is there anyway I can get them to offer me a lower amount without being harrassed?Can I also request them to send me a validate letter stating that if XXX amount is paid then the account will be settle? I have read from previous posting that many people have been lied to. They say they will settle with them for a certain amount and then later said it was never put into the computer or that offer never existed.
