im from alabama and have several payday loans outstanding. some internet and one from advance america. i have never paid on them. stupid me, i know. ive already been garnished once for a loan company debt which was embarrassing enough. they served the paper to me at my job. every day im looking around wondering if the police are going to knock on my door and if not repaying these is a felony and if i could go to jail for doing so. i also have some outstand bounced checks never repaid. any advice from anyone would be appreciated. i feel like ive dug myself into a deeper hole with no way out.

First I would check the payday loan laws in your state. Then I would contact advance america soon before they take you to court. advance is probably the only one that is licensed in your state. They probably will make payment arrangements with you.
For the bounced checks, if you remember who you wrote them out to, I would call them and try and make good on those checks. The places that you wrote those checks out to can turn them over to a CA and then it will go on your credit record but they can also turn the checks over to the DA and the DA can take you to court. with the internet loans, if they haven't contacted you yet, your lucky. They will call you at home and at your job when you default. It is a nasty cycle with them. But don't believe what they tell you over the phone, unless they are licensed in your state. You may want to contact them after you get the other things taken care of first. Good luck and it's great to see that you want to take care of these. It will take some time but in the end you will feel better when you get them paid in full. |

If you list the payday loans, indicate whether they are storefront or internet, how much you borrowed and how much you have paid back, some one surely has dealt with some of them and would be able to advise you on how to handle them.

How can i find out what the law for loans are in my state. I know that all of the payday loan places we had here have all closed because of some new law. It had something to do with a person not being able to have a loan for so many months in a one year period. Does anyone know about this?

has anyone delt with ucl before? they keep calling my job. i have turned everything over to my AG. im waiting on him. he said he would take care of them. im still worried about them when they say that i have to pay by a certain time.

I have dealt with Advance America and frankly I'm surprised they haven't already taken you to court! They can be sticky to deal with, but if you call them and work out a payment plan with the store manager, you should be OK.
They are also a storefront lender, which means they are probably licensed in your state and definately should be paid first. |

I work in the payday loan business. In Alabama a payday advance is usually considered a loan. They usually take you to small claims court to collect. Some send you to collection companies.
As far as getting calls at work about your "bills". Tell them to stop calling you at work. Look up Fair Debt Collection Protection Act. They have to stop calling you at work if you tell them to stop. If you will call the manager they will usually work out some payment plan. They will try to make you think they can't but it is cheaper to work out something with you than take you to small claims court. |

An internet pdl can not garnish your wages. You need a court order to do that , and since most operate illegally they can not get a court order. They can try to do a wage assignment. They are voluntary and you can revoke that at any time.

Well they can not garnish. When you took out your loan you may have signed a wgae assignment.
Just send them something that says I (name) hereby revoke any and all wage assignments that I may have signed for you or any of your affiliates.Also give a copy to your payroll person |

Ok so what if I can not get it to them the company is B.I.G they r very rude people and they have not given me any way to contact them. The only time I can talk to them is when they call me they said they are part of ACH loans. This stuff is huge nightmares thanks for all of your help
