Hi Stanley, thanks for replying.

After I posted that, I got a call from Allied's attorney, who I had called the day before and left a message for. He was a pleasant enough man who offered his Texas bar number, etc. when I asked if he was admitted to the Texas bar as an attorney.

I questioned him over basically everything I could think of, and he said he was closing my case personally (which I didn't fully understand how he could do, since after I got off the phone I remembered the employee I spoke with saying only contact from Avon would close the case.)

Anyway, the thing that struck me the most, and the thing I pointed out to him as a "loophole" would be that he stated the FDCPA terms don't apply to "business" loans, etc. Meaning, that people who sell Avon in some sort of way can be legally harassed (possibly) in ways other consumers can't be. I really need to ask my attorney sometime this week about this, and if he can't answer it, speak with someone who knows that area of the law well.

Since Avon employees are working for Avon, but in an area where they can be considered to be self employed it's considered a business debt. So, Allied can cover themselves that way.

The attorney I spoke with at Allied said my case originally came from a company called L.T.D. (after it was with Avon, but before it was handed over to Allied!)

I will update when I can and when I'm able to do more research on this. I still think it isn't right that these companies would be trading around my information when there's no debt owed.

Yes, you should ask your attorney about this. However this cannot justify their action anyway. If it is a business debt, then also you do not owe anything to them, right? Then why are they sending your account to collection?

It's good that the attorney was helpful to you. Get the whole thing in writing to stop the mayhem by now.

i recvied phone calls and called back and they agreed to a settlement when i tried to make payment was told that was a lie. then when i asked to speak to a head boss got replie of why would they speak to you no you can not speak to the boss then hung up on. i mean if i wasnt going to pay i understand but i was trying to pay my bill. i cried for an hour they were so rude all i wanted to do was the right thing.

That is frustrating. How collectors can be so non-cooperative to the people who are willing to pay! And why did they agree with settlement earlier?

Sadmom, have you contacted your original creditor? Speak to them and explained what happened with you. Your creditor might help you pay these bills. Keep us posted.

Hi guys. I'm reading what you wrote, because I have just recently, on two separate occasions been contacted by this "allied data corporation." They leave voicemails but do not talk to me directly. I did a google search on it and found on one site that it is an agency trying to get Social security numbers from people. I have no outstanding debts to anyone. There is nothing they can do, so I'm not returning the calls anymore.
Next step is to have the phone company trace the calls. After that, highlight the amount of times they call and see if I can get them on some kind of harrassment charge or something.

I have been recieving the same call for about 2 months now. And I have recently sent them a check for the balanced owed about 3 weeks ago, and they still have not cleared it. Well yesterday I get a letter in the mail saying that I failed to follow through with my payment plan, well that is funny because I never set payment plans with them. This company really needs a reality check.

WOW!! Been reading thru these posts and very shocked! I just returned from a military trip to DC and found the exact same message that everyone else got...basically a threat, "Call or else!". Well, lets see, its Sat, they are closed, but I called anyway. Now that I have read all these posts I will be more prepared. As to the so-called "collector" that gets his thrills from taking down e debtors..."Dude get a life and a clue! If you are seriously trying to help your client AND the debtor, then you need to learn some manners! Come join me for my third trip to the sandbox, show what life is REALLY all about!"

I have contacted a lawyer. I paid this off in December of 2005. I have the canceled checks to prove it.
I have contacted AVON myself, but I thought I would tell you idiots too. I am SUING FOR HARASSMENT.

As I understand it, Avon is in cohoots with this scam. They tell new distributors that their first order is 50% off, yet when the bill comes in it is the same cost as the customer's price if not more because they are required to purchase literature as well as product. If anyone needs investigating, it's Avon!

I kept getting automated messages from Allied and recentle a Mrs. Knight kept leaving abusive messages. i do have an outstanding balance. I wanted to settle the debt so i called to set up a plan. Mrs. knight was extremely ruse and kept screaming at me. She told me send the 1st payment through western union which I did. then she asked me to send her like a bunch of checks. i sent the checks. My sister called me at around 8:30 pm and told me that that Mrs. Knight was extremely rude to her and she said that she wants to wire all the money through western union or she will file a law suit. i called mrs. knight and told her that what is the problem since I sent all the checks and she should receive them shortly. She started saying I dont care you papers are on my desk and u are in for a lawsuit and then she hung up on me. When i talked to her a month before when we were trying to set up the plan, I told her that I cannot pay the amount she wanted me to and she said there is no other way. After we talked I got a letter from Allied which said that i can make several payments in the amount lower then what Mrs. Knight said. I do not understand. Can they sue? ... I was trying to be reasonable by taking her rudenbess and shit and trying to pay everything back but she just refused the payment. It is like they do not want to get paid. I have another debt I am almost finished paying off with a collection agency called Crediots Interchange and their behavior is so much different. the people there spent a lot of time helping me set up a good plan and if i need to change the date of withdrawal they are always accomodating. I am 3 months from paying off the debt and it is going as smoothly as possible. Are there more people who were threatened like me when they tried to pay? I read the previous posts and some of the things they did are shocking. Please respond. Thank You.

I, myself, just received a threatening call from David Leyman last night from Allied Data Corp. that I or my attorney must return their call by noon today. I phoned them as soon as I got home last night and spoke with a very rude lady at Ext #602 and she informed me that I owed Avon $30 and I must pay it immediately or they would turn it in to their Attorney. I told her I didn't understand and that I never bought or sold for Avon ever. She then said the last 4 digits of my social security number and asked if they were mine. Yes they were, but "how did you get that?" I asked. She said that doesn't matter & you need to pay us. I quickly replied I would not pay it & she said "fine! It will go to our Attorney" and hung up on me. WOW! I tried to call back to get more info but they would not answer. This is really frightening to me. This morning I did some research on the net and found this site when I typed in Allied Data Corp. I took some advice as previously stated and phoned Avon Collection Dept. I have not received any call back from them. What do I do now?

Kristi,

Go through the posts of this thread thoroughly. You will easily understand how to deal with them. For the time being, wait for the response from Avon.

Is this item appearing in your credit report? How old the debt is? Also keep watching your bank account, don't forget they have your SS#.

Hey Hammer,
Good to hear someone's on my side - you rock! You debtors are all the same. "They harrassed me, they were rude to me". "I'm going to find someone to complain to so I don't have to pay my debt."
Pay your bills and you won't have to worry about these big bullies trying to make respectable people out of you!

I got your call today about needing to hear from me or my attorney by tomorrow. Well it aint gonna happen. I owe no one money and you had better make sure you have the right person as there are many Johnny Timmons. I get phone calls and businesses wanting my social security # so they can verify who I am. Doesn't matter if I know you or not, if I owe I pay. If you all want to dance just let me know and I will bel glad to oblige. I might just come check out your little company. I do not make any threats, but only promises and unlike a lot of people in this world today my words are true and I don't lie. You all have a nice day and don't call me anymore!
