ALLIED DATA CORP

They call me about once per month and leave me a message saying that if I don't, or my attorney doesn't, call them back by "noon tomorrow" they will be making a decision on my account. They must be very indecisive, because these messages have said the same thing for at least 1 1/2 years. Whatever. It's probably past the SOL anyway.

Just got a recorded message for either me or my attorney to call their number by noon tomorrow. Didn't have a pencil & paper handy so I don't even have the number to call them back. I owe no one a penny... anywhere! Me thinks it's a scam!

How come you won't pay your bill? Do you owe somebody $140.00? It's not nice that maybe they are rude, but you should pay back the money that you owe.

Nobody is saying that they are not paying their bills. If companies would work with their customers, their wouldn't be this problem. Companies state that if you run into financial difficulties, they are there to help. Then when you call the place, they state either pay now or we will turn your account to collections, we will sue you, etc. I am really getting tired of people coming on here with the comments of "How come you won't pay your bills?" This forum was made to help people that are in financial trouble and are looking for help in handling their debt.

I recently got a new cell phone number. Apparently some chick had the number before me and did not pay her bills. These people (AD) keep calling about every week or so with some computer generated voice telling me that Me or My Lawyer need to contact them. Well I did and they still keep calling (After 3 people hung up on me before I finally got someone to listen). What a bunch of unprofessional idiots. I may have my lawyer call them. I don't know what else to do to get them to leave me alone...besides changing the phone number. What a load of garbage!

does anyone know anything about this company. they have called like 5 tiems the past week. I have gotten no letter from them, though I know I owe AVON. I would like to call avon and pay them. I am fearing that if I pay, I will still get calls later saying I still owe. I live in MO in the CST does anyone know the calling times as well. They call at 10 PM????? I know that is way late...

thanks

I am in shock to find this thread!!It is amazing to me that this Allied Data is allowed to do what they are doing to people! What a sad excuse for a scam or if it somehow really is a legit collection agency.

I received a call on my cell phone( HOW DID THEY GET MY CELL PHONE NUMBER??? its in my husbands name, costs money every time they call! ) my 10 year old son answered and got the " sent to our attorney message"...
My husband called the number on caller Id back and talked to a women who would only say I owed Avon $92. and that I needed to pay immediately or it was being turned over to the company attorney.

Now.... I did sell Avon about 4+ years ago. I had a customer who vanished after purchasing this amount of items. I returned the items to Avon and waited to see the credit to my account. It never happened. I contacted Avon to no avail and eventually sent them a certified letter stating that I had my delivery confirmation(copy of it) etc..etc. of the items. I was not able to check the account any longer because they closed it. I assumed everything was taken care of because I hadn't heard anything different. Wellll.... fast forward to the present day. I am 4 years older and much grayer now, more kids.etc..etc *lol*
This Allied place calls and threatens me?
During my husbands return call... he very politely asked for a paper statement. He told them that this is the day of scams and that there was no way we were sending someone money that we didn't have a clue who they were. He asked for the number to AVON to confirm, verify, and question what this charge was for. Why was this company calling and Avon never did?
she was screaming at him at this point saying....

" I dont know their goddamn number" and " We arent sending you any more F*#&@ papers in the mail because we have spent enough on F#*$#@& postage"

WOW!!!!! is all I can say.Let me rush out and send you my money.. NOT.

My credit is perfect and always has been. This person at Allied was not talking to some lowlife scum. She was talking to educated, upper middle class people who pay their bills. All we wanted was some type of proof that they were legitimate.
And the response was shocking. Swear words and screams. My husband at one point told her he felt as though he was trying to calm down one of his misbehaving children as she was out of control.

I am baffled that this company is trying to collect money this way. I cant even say collect because I still have no proof that they are legit.

For all I know it could have been the people who stole my credit card number a few months back and charged $3000 at home depot on it. It the day and age of identity theft and this company is living in the dark ages.
. These people are unwilling to offer any proof as to who they are. We work hard for our money and I for one refuse to be treated like this. Let them take this to court. Gosh how I would love to see them pay some HUGE fines for their illegal tactics and sick way of calling people.

Want my money?????? treat me with respect. Period!

How do we know what to pay when this company will not supply a debt validation letter? Or something in writing? We could send checks the rest of our lives and without proof of what the original debt was it wont matter....

For those that are writing post dated checks....

----Demanding a check post-dated by more than 5 days is a violation of the FDCPA and they can ONLY ask for the post-dated check IF they notify you IN WRITING that they are going to then deposit it.
Quote:

"§ 808. Unfair practices [15 USC 1692f]

A debt collector may not use unfair or unconscionable means to collect or attempt to collect any debt. Without limiting the general application of the foregoing, the following conduct is a violation of this section:

(2) The acceptance by a debt collector from any person of a check or other payment instrument postdated by more than five days unless such person is notified in writing of the debt collector's intent to deposit such check or instrument not more than ten nor less than three business days prior to such deposit.

(3) The solicitation by a debt collector of any postdated check or other postdated payment instrument for the purpose of threatening or instituting criminal prosecution.

(4) Depositing or threatening to deposit any postdated check or other postdated payment instrument prior to the date on such check or instrument. "

The message they are leaving on my phone must be for the last person to have my number since I don't owe anyone anything and just got the phone number! Hope my call to them stops the calls. Otherwise they might just hear back from my attorney, and believe me, they don't want to have to endure that!

in some states, a person can actually be arrested for non payment after judgment has been obtained under the states contempt laws. they make a motion called "motion to enforce litigants rights," and if it is not answered, the judge can lock a person up until they answer questions, make payments, or arrangements to pay.

the key difference is that in such a situation you are ignoring the court and the court is using its powers to seek compliance with its mandates..
