Default Need advice please!

Ok..so here's my situation. I have several loans out, and several I've paid off in the past. Based on what I've read on this forum, I'm actually owed money by all of the companies, even with the loans I have outstanding. My question is, with 5 potential debits(apparently illegal or fraudulent)coming up next Thursday(which will of course, hurt me financially) is it realistic that I can have this debits stopped by ACH revokation? Unfortunately, due to my credit, I was unable to get a bank account on my own, I had my step-dad as a co-signor. I'm afraid if I close my account I won't be able to open another one(I had 1 NSF last September because of the loans). Any suggestions? Has anyone in this situation been a current customer of Chase bank and were they helpful? At this point, I'm considering hiring an attorney to collect the refund fees and offering them 50% of what they recover. If anyone knows anyone in Arizona I'd be interested in speaking with them.

Are all these payday loans? If so, some may give refunds and some may not. If you get the debits stopped, that will be a big plus. If you cannot get refunds, you may just have to cut your losses. It might cost more to hire an attorney than what you might get back. Provide a little more infomation and someone here on the board should be able to help you out. List who you owe, how much you borrowed, how much you have paid back, etc. That gives people a place to start.

Why can't you open a bank account? I may be able to help you with that . . . . Another concern you need to think about is if your current account goes negative your step dad will be held liable too . . . It may make it difficult for him to open any bank accounts too.

What companies have you borrowed from and how much did you borrow/pay back so far?

As far as the bank debits go, they may be costly to stop. You would have to do a stop payment on each one, and even that may not stop the transaction from going through. If you close the account the bank will likely force it back open once the ach transactions go through.

ameriloan 400 principal 120 interest
United Cash Loans 300 90
GECC 300 90
CashNetUSA 500

I would also recommend talking to someone at the bank and explaining your situation and see what they suggest. Some plces will work with you and help you out. It might take a little work on your part and maybe a little embarrassment, but better to be a little embarrassed now than a lot later on. Right now take one step at a time and provide the information that was requested and go from there.

Whoops, hit reply too early.
According to Arizona state law, I've had three loans out with ameriloan before, and have apparently been overcharged $382.50, $472.50, and $570 per loan. Obviously, that's more than my outstanding loan, which they are currently charging illegal fees on. With United Cash Loans, same situation, Gecc paid overages of $382.50. I'm ok with Cashnetusa, they seem to be a decent company,and have the lowest interest rates. That loan will be paid in full next week. Each of these companies owes me more money than what I owe them. What do you suggest? I am planning on going in and speaking with my bank either this afternoon or tomorrow morning, depending on my work schedule.

Oh, and the bank account--poor credit and a tax lien.If I had good credit, I wouldn't be relying on the payday loans. I've been working on improving my score and it's gone from a 480 to a 560 in the last 6 months, but still an issue with the banks.

Why is it that you think you can't open another bank account? I may be able to help with that . . .

It looks like you may be right about you pdls. I'd suggest writing them letters stating your case and push to get them to mark your loans paid in full.

If anyone can find you a bank it is goudah. My credit score isn't that great either, but was still able to find another bank and open another account, although I have to keep my other account opened until everything comes to a zero balance, which should be soon. I know it sounds bad to say, but even though you have over paid some of these places, I would not count on a refund. Push for it, but unfortuantely it does not mean that it is going to happen. I have one company that I should get about $1000 back from, but don't know if that is going to happen and another, should be close to $200 and doubt if that is going to happen either. I hope that you can recoup some of your money, but just don't count on it yet.

Glad to hear you are going in to talk to the bank. Our bank was very understanding and is working with us to get the debits stopped from our old account. We have to go into the bank every time a debit hits and fill out paperwork, but at least we can get things reversed. Oh, I did forget to add, that when we did this, our bank wanted proof that we have notified these companies that we were revoking authorization to debit our account, whether it was through USPS or via email or something. We did all of our through email, so that helped. But find out what they need for you to do to stop this.

I just emailed letters to ameriloan and United Cash Loans, so we'll see what happens. I'm not too confident about United Cash Loans considering the posts I've read here.

I figured they'd give me some problems, so I faxed them as well. I'll be sending out letters by certified mail tomorrow and calling them as well, but I won't feel satisfied unless I see something in writing. Good thing about the fax is I can verify it was received as opposed to the email(service wouldn't let me use a read receipt).

ameriloan replied promplty and settled my loan. I resent a letter to United Cash loans by fax and email, and I'm taking the revocation into the bank today. I'm not going to deal with them by phone if they're that shady. I want everything in writing for the bank.

You never responded about the bank account situation . . . I may be able to help you get an account that you won't need your step dad to cosign on . . . . Just let me know why you can't (chexsystems report, fraud, ect) and I will let you know if there are any good banks in your area.

I tried to check my account with UnitedCash Loans last night using my user name and login and it would not let me in. Said for something like site is for customers only, so I guess I am not a customer any more. LOL Can you tell it just breaks my heart?

Gypsy ~ if you don't hear from them for a little while, try to log into your account and see what happens. Like I said, they never responded back to me or anything, but I can't log back in now, so I am taking that as a good sign.

Do contact Goudah about the banks. She helped me find one.

That's a good idea. I'll try that. My goal right now is to not close my bank account. I have too many other payments coming out of there and it would be a mess, but if I can't rectify this situation, then I may look for a new one.
