Statue of Limitations on Debt Collections

Does anyone know the exact law # in Arkansas that sets the Statue of Limitations on Debt Collections

What kind of debts are in collections? Is it secured or unsecured? The SOL laws in Arkansas are as follows.

Written contracts: 5 years, NOTE: Partial payment or written acknowledgement of default stoppeds this statute of limitations. (A.C.A. 16-56-111)

Contracts not in writing: 3 years, (A.C.A. 16- 56-105)

Breach of any contract for the sale of goods covered by the UCC: 4 years, (A.C.A. 4-2- 725)

Medical debts: 2 years from date services were performed or provided or from the date of the most recent partial payment for the services, whichever is later. (A.C.A. §16-56-106)

Negligence actions: 3 years after the cause of action. (A.C.A. § 16-56-105)

It would be a credit card account, unsecured. My Friend had a Citibank Visa, I think and was making payments around 1999 & 2000 when she noticed that the payments were not being deducted. She contacted them and tried to get the error fixed. Even though she was making more than the min. payment, they were not showing it and then adding late charges on top of that. She told them that she wouldn't be making any more payments until they fixed her balance and showed it correctly. She tried for two years to get it straightened out. She finally just gave up. Now, after all these years they have turned it over to a collection agency and then a law office. We traded phones & numbers years ago cause of a guy and I was getting calls asking if I was her. I would ask who they were and they would say they couldn't tell me until I gave them my SS #. Well that didn't fly with me and I told them not to call me again. But we think it might have been the collection agency. Just last week she got a letter from a law firm and the balance owed has gone from a little over 1500 to 5900.

Send a debt validation letter to the CA for showing the account specifics. You need the send the letter through certified mail with return receipt requested and keep a copy for records. Wait for them to validate your account. If the last payment was done in 2000, not only the SOL is expired but it should not be reported on the credit report anymore. This is because negative info stay on the file for seven years starting from the date of first delinquency. You need to dispute the item with the CRA and get it investigated.

If you had a car reposessed 8 yrs ago. Can the creditors come after your assets or garnishments today?

delivered merchandise to a client on a 48approval , it has been 3 weeks now she has decided she's going to keep the merchandise but will not pay the invoice owed on it.

Sounds like you need to sue her...contact your local district attorney's office to find out if there are any applicable criminal penalties, too.

medical bill for deceased husband from 2000. health insurance would of paid it or most of it but they never billed them. now they want me to pay them.

Is there a time period in which someone can send a bill for services?

Is there a time period for collections?

This is for the state of Indiana and is for lawn care services?

Is the SOL different on Non-secured and Secured Debt? Does it depend on the state you live in? Or, the state in which you acquired the debt? Wow!! More information, on this pls...thanks.

about 6 years ago i got a mortgage and paid off old debt with that mortgage company. now one of the debter is coming after me for more money. i live in maryland. my question is can a debter come after you for more money if the debt was paid with a collection agency. i am in need of help.

I had a procedure performed in 9/05. My
HMO has not paid the Hospital. B4 the procedure I sumitted all proper forms and refferals. Non payment may be due to billing
error. Now it is with debt collector. Am I
liable after almost 3years in 06/08 in Illinois?
