In 2001 my husband and I filed for bankruptcy - it was discharged in May 2001. My husband is now deceased (he passed away in 2003) I am now in a debt management program with T & C. I have my pdls, credit cards and personal loans with them. What I would like to know is that can I file again in my name only for bankruptcy or do I have to wait for the 10 years? Thanks.

Chapter 7 bankruptcy can be filed again after six years has passed from the date of your last filing. A Chapter 13 bankruptcy can be filed at any time. Is it your only option available now? I am asking this because your credit will have this negative remark once again for the next few years if you decide for bankruptcy.

I am really undecided on what to do = its just a thought - I can stay with debt management for another year.

I believe we filed chapter 13 - and I thought even chapter 13 was on you report for 10 years - or can I file under my name now since my husband passed away?

Yes, if there is a situation, you can file for a chapter 13 Bankruptcy in your name. Chapter 13 stays in the credit report for 7 years. Can you talk with your consolidation company and explain them about your situation? They may do some changes on your existing plan so that the repayment doesn't get hurt.
