Does anyone know of someone who has filed suit against the law office of Peter Francis Geraci for malpractice? We received a Presumption of Abuse letter from the Trustee because Geraci's office incorrectly filled out some information. It also took them 3 months to file our case after they received payment. It takes their office almost a week to return any calls. Any feedback, suggestions will be appreciated. Thank you.

Geraci's office is what I call a "cookie cutter" law firm. There is almost no personal involvment in the matter and it's run like an assembly line. Get you in, get you out, they get paid, and onto the next one.

I come here from a creditor's standpoint, and I just want to share an experience I had with Geraci's office...

One of my customers had a car loan with me, and she subsequently used Geraci to file a Chap 7. Being a secured loan, the debtors' options were either reaffirm the debt to keep the car, or surrender the vehicle to me.

When I got the BK notice, I called Geraci's office to ask what the debtor intended to do with the car? Whoever answered then looked up the case and told me the debtor intended to reaffirm -- that I should draw up a reaffirmation agreement, fax it over, and Geraci's office would get the customer to sign it.

So I did just that. 3 months went by and I never got the paperwork back. I called Geraci, they said they "don't know what happened" to the paperwork, and I should resend. I did by fax and through the mail.

2 more months went by; next thing I know the case is over with and the court is sending me discharge papers. So I called Geraci's office...

They looked up the case and said "Yeah, it was discharged." I said, "you know I can go take the car if I don't have those reaffirmation papers." Here's their response: "Go ahead. We got paid, we really don't care what you do at this point."

Kind of ballsy of them, even gave me a bit of a shock to hear them say that. So I called the customer (which I really am not supposed to do, but I knew she didn't want a repo) and I said "your lawyer just told me to take your car. Do you want that, or do you want to reaffirm?" The customer then told me Geraci's office never forwarded any of those papers to her, and that she had told them she wanted to reaffirm. She ended up coming into my office to sign a new contract, without the 'help' of Geraci.

I don't know of anyone filing a suit against them, but from the commercials they have on tv here, your stories don't surprise me a bit.

I went to Geraci office to file chapter 13 and the only thing they were interested in was getting paid. To make a long story short we had to cancell our service with them because they never did any thing but took our money

Dear Unhappy client of Geraci, I am so sorry to hear that you had a bad experience with Geraci's office. My husband and I do not know how they stay in business. They were eager to take our money but when it came time to file they always needed more and more paperwork. Our Chapter 7 is finally discharged and we are going to file a complaint with the Better Business Bureau.

I'd heard of a legal malpractice case filed against him for not relaying a settlement offer to his clients. I think the attorney handling it was Barry Doyle who has an office in Chicago. Also the Illinois Attorney Registration and Disiplinary Commission regulates attorneys and you can find out how to file a complaint at their website.

File that complaint. I had to do that to an attorney that I had hired and gave $1,000.00 to and did noting for me. He got disbarred after myself and several other clients complained to the disciplinary committee because I wasn't his only victim and I actually got my $1,000.00 back believe it or not.

Anyone thinking of going to Peter Francis Geraci to file bankruptcy, GO SOMWHERE ELSE! FIND SOMEONE WHO CARES! No one wants bankruptcy but sometimes its the only way out. These people are not compassionate; are not supportive. They are just in it for the money. Once they get your money, then they are slow to reply to any problems or questions you may have. A total lack of communication. This is your life and your future at stake and they couldn't give a damn.

They have been open since 1977 and have only 8 bad comments. Well then I think they are doing a pretty decent job. All firms from Chase to Peter Francis GEraci have their bad cases they screw up and the others they do beautifully. Never is everyone ALWAYS happy with any firm, or person (believ it or not some people have it out for Obama). Additionally, they have never been sued I did my research on them.

Thank you very much for all your comments. I was actually thingking about hiring his office for my case. After reading all these cases I have change my mind. At first I was not so sure becuase when I talked to them over the phone it sounded like they were eager to take my money only and that was something that really got me thinking about giving them my case.

9 months after my first visit to their offices, my "attorney" is no longer "with the firm" I have re-sent the same documentation 3 times now, this same attorney NEVER replied to an email or a phonecall, if I was lucky I would get someone else in the same office who would look up my case and tell me everything I was doing wrong. During that 6 hour a week window you are allowed to call, I'm sure other clients are familiar with this. I've had one vehicle repossessed, 3 garnishments now in place against me, and one more pending. (Thank God with the filing that was stopped, but a Merry Christmas it wasn't) I wasn't happy about having to file bankruptcy in the first place, but after my husband and I lost a collective $15 per hour in wages over the last year due to forced job changes we had no choice. Geraci's firm has certainly not made it easy. Our case was FINALLY filed last month, six months after I made my "final" payment and paid filing fees, and then only a week after I sent an email stating I was hiring another attorney, suddenly my case was filed. Please folks DON'T retain this firm. They are crooks, I too will be filing a complaint with the BBB as soon as my discharge. I don't trust them enough not to do something to mess up the BK for retaliation if I file a complaint before.

Please reconsider using this firm. As people have stated, they are only interested in your cash!!! They refused to amend my plan, made several errors in calculating my pay and subsequent deductions AND refused to return my phone calls and email. I was forced to have my case dismissed. At one point, some paralegal told me to sell my house---the audacity!!!
I too, will be filing with the BBB!!!! They are crooks and should be ashamed of their conduct.

Ina, I appreciate your opinion, however, if you have not used their service you can not be aware of their business practices. I'm sure many people have had positive experiences, but I am not one of them. I think you don't see a lot of complaints because people are sick and tired of dealing with them and they are GLAD, overjoyed, and freaking HAPPY to be finished with this law firm.

My husband and I filed a chapter 13 with Peter Francis Geraci in 1999. It was actually a very good experience. They were very good with returning our phone call and our case was filed without problems. We finished paying for it in two and a half years and our credit has been very good ever since. I am sorry that some of you experienced bad things but I would definitely return to him if I ever experienced credit problems again and I would most definitely recommend his services to my friends.

I too had a wonderful experience with the Law Offices of Peter Francis Geraci like R. Jackson. When debt consolidation only made my situation worse Peter got me out of debt and I have been debt free for over 5 years.
