If it was a joint account most likely it will remain on the other persons credit report. The bankruptcy protection would only cover you from being obligated to repay the debt, not the co-signer.

Yep, this is right. Had it done to me also. If this person was a co-signer, the company, if they wanted to, go after that person for payment regardless if they used the card or not. Most of the time they do not, bit they do have that option.

You also have to remember that in most bankruptcies you aren't actually eliminating your debts. You're just making it so that your creditors can not come after you or try to collect the debt from you. Thats why your co-signer is still responsable for the debt. I had to re-affirm two car loans that my father-in-law co-signed for when I filed for bankruptcy just so I wouldn't throw his credit in the garbage as well. It was extremely difficult making the payments and he ended up taking over the payments for one of the loans.

That was definately one of the lowest points of my life.

But now, four years later, my wife just graduated nursing school and I have a good job with a bank and we actually can pay our bills on time so there is always light at the end of the tunnel my friend. Very Happy
