Restrictive Endorsement-Sears/CBSD

Hello,

Looking for some guidance. I sent a debt settlement letter to Sears/CBSD, CMRR, at the address on my credit report. It has been 30 days since they received the letter, and they have not responded back. I am asking for update to the account as paid, removal of all negative TL, or alternatively a deletion of the account.

Now I am ready to send the cashier's check. Since I have not had a response, I have the following questions:

1. Should I send the cashier's check to the same address on my credit report?

2. Will the letter/check automatically be routed to an authorized agent within the organization for execution?

3. Should I call Sears/CBSD prior to sending the check?

4. I live in California, the account was opened in California, but the address of the Sears creditor is reported in Nevada. Will the restrictive endorsement hold up? I have followed the procedure as outlined in the statutes for California.

5. Should I try to locate the higher ups (BBB) and send them the check with a copy of my 1st letter? The BBB for Sears in Calif states that all credit card inquiries were to be directed to CitiCard in New York, but I was unsuccessful in locating an address.

Thanks for any advice and guidance.

I wouldn't send any money yet. You want them to agree to your proposal and terms of settlement in writing before sending any money. Otherwise, you run the risk of them taking your money and not updating the acct with "paid as agreed", removal of all negative TL or completely deleting the acct. from your credit reports.

You could try calling the company's in-house collections/recovery dept. and asking where settlement letters should be sent, just to confirm that your letter is going to the right place, and send it again. But definitely don't send them any money until they agree to your proposal and terms in writing.

Contacted Sears regarding address for debt settlement. I was told the account has been sold to Resurgent Capital Services. I did receive a letter from Resurgent back in Febuary but I did not respond. If I respond now with an offer to settle the debt in full, can I also request that they delete the account? They are not reporting on my CR, but Sears/CBSD is. Thanks for the advice.

If you have "SEARS/CBSD Address PO BOX 6189 SIOUX FALLS, SD 57117 No phone number available" on your credit report, and you would like to cancel your Sears Credit Card, call their general number 1-800-917-7700. (Citibank bought out the Sears financial operation.)

You may also see MCYDSNB and VISDSNB on your credit report, which are both Macy's credit cards, and you can reach them at 1-866-593-2543.

You'll have to fight with a computerized system which will ask you for the account number, which you may not have. You may have to enter zero on your phone several times, or say gibberish into the phone until it transfers you to a human being.

They just offered me 55% at 120 days delinquent - I'm going to wait for 40% if I can get it - it's all I can afford at this point.

40% is a pretty lowball number. I won't say it's not possible for them to go that low, but don't hold your breath. 55% is actually a very good number, they've basically waived all their interest and even cut into the principal amount borrowed (where I personally believe you should at least repay the entire principal).

The difference between 40% and 55% is at most a couple hundred bucks. If you can manage somehow to escape it together, I'd take it. After they charge it off and sell it, the numbers won't be that low, and they could possibly end up suing for 100% of the balance.
