Checking back every 2 minutes asking "are you done" I was terrified of this man. I asked to speak to someone else since all he did was yell at me but he said "do you think I want to talk to you? I just want you in jail" I made $400 payment today--

Too funny. I love collectors who know how to punk deadbeats.

Thank you so much for the info. Can you please clarify which address is the address I should send the cease and desist letter... the address in Jacksonville, FL or the address in St. Augustine, FL? What happens if the refuse to sign for the certified letter. I read somewhere (I have been all over the internet these days doing research) that if you mail it certified with return confirmation requested that even if they don't accept of sign for it that will serve the same as if they did... is that correct?

I really want to see that these criminals are stopped. My 8 yr. old daughter is still affected by this... if the phone rings or someone knocks on our door she will panic and beg us not to answer because she is so afraid that I will go to jail like this jerk said and she will never see me again. How can people be so cruel to anyone.

I just want them to be stopped.

Yes... they absolutely did... they told my daughter when she answered the phone. She told them that I wasnt available (I was in the shower)and I guess they didnt believe her and they proceeded to tell her to say goodbye to her mommy because she was going to jail and she would never see me again... she still asks and worries about what they said. There has to be some law about that... my daughter is only 8 years old. There has to be something I can do about that.

Mrs. Kane, it's time for the gloves to come off. It's one thing to threaten you but threatening your daughter is WAY over the freaking line! I've given you the contact information so you have the information needed to locate them. I would strongly suggest getting a attorney (you can try naca.net) and take them for everything they are worth. You may wish to have your daughter testify to what she was told to lend the case that much more credibility (and up the punitive damages significantly)

Mrs. Kane, I do believe this company's over the top/illegal collection practices just let you win the fdcpa lottery. They will probably want to settle out of court, I would suggest taking it all the way because it needs to become public knowledge. Also you should file complaints with the Attorney General for your state as well as theirs and the Federal Trade Commission.

I mailed out my Cease and Desist letter yesterday to the address you provided me in Jacksonville Flordia... certified of course AND with return receipt request. So know we wait and see what the response or no response with be.

I dont know what to do go a threating call today saying that if i dont pay $1550 today on a $390 payday loan that i will be arrested at home or work will this happen do i pay them anything

If you can record them saying that (let me know what state you live in so I can look up if you can record without their knowledge in your state first) then they may have given you $1,000. Threatening arrest or accusing a person of a crime for a debt violates the Fair Debt Collection Practices Act. Debts are civil matters, not criminal. They cannot charge you with a crime nor can they have you arrested and threatening you with said action is a violation of federal law.
