Plaza Associates......

Yeah.....Looks like Plaza is at it yet!
Set them a DV letter on March 25, 2006.
Never did get validation from them.
But yet, they decided to send yet another settlement offer, without bothering to validate their claim.

Would another letter be in order? Or would that be asking to much of them??

Or is legal action of any sort a possibility?
If so, what?
Because they're still attempting to collect on an UNvalidated claim.

As always, information is appreciated.

Send another letter, and state

that in regards to your settlement offer I am writing for validation. You must have not received my first letter, so I am giving you another 30 days to validate, before I ask for this to be removed from my credit file.

Something along those lines. If after 30 days you still don't hear anything, write a letter to the credit bureaus, and inform them of the situation. Provide a copy of the first letter if you have it, to both....the collector, and the bureau.

By the way, did you send the first letter certified?

it is important to remember that the fdcpa does not place a limit oh how long a collector can take to validate a debt, meaning if they pop up in a year and validate it that is legally good enough. If the settlement offer is fair, then tell them you reserve the right to accept that offer at such time as they do provide your with the requested validation ( you could also go the rout of they are violating the FDCPA by continuing collection activities after you requested validation, even though they failed to provide that validation).
