I really need some help from you all. I had an old Providian account that was sold to Chase creditor and was unpaid. I was then served papers from a lawyer representing Palisades Collection LLC who are collecting for Chase. I settled this account with Palisades in full and was told my court case was dismissed and everything was good. Now I am getting harrassing calls from another collection company trying to collect on the same account from Chase that was already paid to Palisades Collection LLC. What do I do now? I have contacted Chase and they are claiming they sold my account to this other collection company (not Palisades, which is where I paid in full the past due acct). I contacted the lawyer that originally was representing Palisades and they are stating that the debt is closed. Why am I still getting threatening calls and nobody seems to no the answers when I call them on the phone. Are these collection companies for real???? What can I do to get this cleared up? I have already sent letters to the second collection company showing them that this debt was paid to Palisades. Please help............. this is appearing on my credit bureaus and screwing me up...........

If I'm not mistaken, you can dispute the derogatory info on your credit reports regarding this acct., so the credit bureaus will have to try validating the debt with the collection agency that is hitting your credit report. If you have something in writing showing that the debt was paid in full to Palisades for the Chase acct., provide copies to the bureaus as backup.

Did Palisades provide you with a written debt validation letter when they started attempting collections on this acct? If you have a copy of that, I would include it along with the documentation that shows you paid the acct. off with Palisades.

You paid Palisades on the account they brought in front of you. Right?? Did you receive anything in writing before making the payment? They are also supposed to send you a PIF mentioning that you don't owe towards the account. When you are calling them, they say that the debt is closed. Insist for a PIF in writing. You can show that to the new collection agency now contacting you. You also want to make sure that this one is doing proper collections. Get the debt validated to confirm that they are authorized for this thing. If they can provide you the info, you will need the proof of receipt and the PIF letter from Palisades. One of them is collecting money without proper documentation.

What exactly does a validation letter show? Does it show the full history on the account they are trying to collect on or just a balance due?

This is a very common question in which many people aren't sure what should be expected from a collection agency when asked to validate the debt. Besides, the collectors also give incomplete information knowing about the consumer's inadequate knowledge on this part. The fdcpa laws are the best reference. The link is attached below. Get any reciepts of payment to the first agency. Send copies to the new collection agency along with a debt validation letter.
