Hello, I just received a phone call from the Legal Mediation practice firm because of a unpaid payday loan. The representative was kind and considerate but then he placed his obnoxious supervisor on the line. He yelled and threatened to arrest me from my resident or place of employment. Is that possible? Then he tried to record me stating I couldn't pay the balance in full but I refused. Was that the right decision? Then he also yelled I was a criminal and I committed a crime but I never refused to pay the amount, I wanted to make partial payments. Was everything he was threatening true?

A) He cannot come and arrest you. That's a total lie on their part.
B) You are not required to allow them to record your voice. They are required to tell you they are recording your voice. You can say no.
Have you asked them to verify the debt? Are you sure you owe this money?

Welcome to the Commuinty Like Jeff said, you need to make sure this is your debt and it is accurate first. They can, and will threaten any and everything. If this is a store front pdl, you need to see ifyou can work something out with them. They oftern do take action,unlike alot of the internet ones. If you have any questions, feel free to ask!...Karen

Someone can correct me here but this is what I know.
Several states allow recording of the debt collection phone calls secretly. Neither the collector nor the person has to inform about the call being recorded if s/he is living in one of the 35 states mentioned here.
If someone is living in the state where the other party has to notify the other person before recording, going against it will be a violation of the state law.
Nikki, check your state laws if the collector had the rights to record your phone calls secretly. If he was supposed to take your permission (and he did), and you said 'no', he should not do anything after that.
Don't take the harassments and verbal threats by the company. You should report them to your state attorney general and the FTC and request immediate inquiry. If you know the original creditor, try working out something with him.

You are correct. I guess I should have clarified myself: if they are in a state that requires two party notification, they have to tell you.
My experience is that most ask anyway, just to cover their butts.
