I actually just received a judgment, it's on the top header of my credit report. The plaintiff was labeled as Marshall and Ziolkowski. I've never heard of this firm, so I googled them. They seem to be a debt brokerage office. They purchase indebted contracts and sue them. I never received a notice from them. I would have just paid off my account if I knew about it. Here's another thing.. the judgment is three times the amount of the line of credit.. go figure.

Think of things this way---im sure some people make mistakes with credit cards and debt but in the end it makes sense to just pay what you owe. What if the $$ was owed to you--you would wanna sue!! Right?

also.. I called them and ended up paying the whole thing off. They told me they attempted to contact me, I'm not listed so they didn't have a way of reaching me. Just goes to show.. You can't hide from debt. lol. oh well, at least it's taken care of now. Big load off my shoulders.

Those morons know of the rules the Federal Trade Commission has against people like them from calling your place of employment and bugging your relatives repeatedly. They assume the person they hunt for isn't aware of the FTC rules and gamble making calls to their place of employment and get you to start paying them when they know damn well they can't do this. They did this to me and I hope I can muster up the funds within the next couple of years to sue their asses for harrassment.

Don't owe them crap, if you're going to file suit against them for fdcpa violations, you have one year to do so. If (probably) they violated state laws, there is a similar timeframe in effect. You might try looking for an attorney on naca.net.

They are taking me to court for fraud. I've had an outstanding account w/ bank of america since 2002. It was at $1000 when i left it, and now they said its at $9000. They also said that I left it at $4000 with the bank. I asked for proof through mail, but all he gave me was my social security and address. Right now i'm preparing a debt validation letter. Did anyone else experience them? They are rude and I don't like dealing with them. Did anyone else get charged for fraud by them? Any advice would be great! Thank!

Wow, how exactly do they say that you committed fraud? I have never dealt with this company but that does not sound right. You are doing the right thing requesting the debt validation. Hopefully someone will be along soon that can give better legal advice than I can. Good luck Smile

They said that I borrowed money and never had the intention of paying it. I wanted verification so I could start making payments but they want the full $9000 which i don't have.

I don't know that they could make a fraud charge stand up in court.....things happen and people get behind and it snowballs. Just stick to your guns and get that debt validation and go from there. Let us know what you hear from them. They inflated the balance quite a bit........

Vin, you did the right thing. If they can't validate the debt, then they have nothing to stand on. Good luck, and let us know how it goes. Smile

Please remember people if you made the slightest effort to pay,the fraud charge has no legal basis to stand in a court room.
