Hey Guys I have a question? Can Wells Fargo repossess a house if payments are 34 days late? I got the biggest butt-head on the phone today. Told me to cut down on food and to also cut my TV off and phone off and I could pay them. I hate these people beyond hate. KYSIDE38

Oh my goodness! Kyside, what an awful person you must have had on the phones. Sometimes these people are SO hateful.

From what I understand, it takes a LONG time to get a foreclosure done - from start to finish, it can take months. Are you in a position to be able to catch up soon? 34 days is such a small amount past due, I think they may be threatening you just to get the payment in, rather than actually planning on going through with it. Did they actually SAY they would foreclose?

Isn't that a vieled threat? If it takes months maybe a year for a bank to forclose what makes WF think that they can reposses you that fast without a chance to make good on the payment. A hous is not a car that can be taken in the night!!

I know Wells Fargo will do anything to collect the money. They will make all kinds of threats and insist legal actions if you are unable to do the payments.

Are you able to work out any payment plan with them? If you are not closer to your payment proposal, involve a debt counselor.

Precisely, irish - you summed it up very well. I really think they are just trying to threaten to foreclose to get the payment in their hands. Yes, the payment is overdue, yes, they need the payment, but I think any threats of foreclosure are just that - threats.

Linda-what an idiot!1 We lost our home to forclosure many years ago, and they didn't do anything until we were 3 months past due, then gave us time to make it all up. We couldn't, so we did an assisted foreclosure, even then it took several more months...Karen

I am so sick of these people. Thats what they said I would be in default and they would start foreclosure. I regret the day I ever got them.If this was my local bank they would not have said such a thing. KYSIDE38

Kyside - relax and try to work something out with them, hun. I think if you call them and talk with them, they will work out a repayment plan where you can pay them enough each month to get caught up. Please keep us posted on how it works out - I was in this same situation recently - but not with WF.

I always thought you had to be 3 payments behind, at least that is what is seems to be with the people I know. Wells Fargo people are pretty dumb, I had them call ME and offer to help me out of my financial problems, after someone at LVNV told them I needed help!! I said, I don't even know who you are, and by the way, how do you know of my fiancial problems!!..Karen

Guys I offered to do a check today for Jan 4 they have always wanted me to do that before. Not today. Its going to be paid Jan 4 but they said they could not take it and would call me 5 times or ten times a day if they wanted to. The reason this happened my husbands check got messed up with the direct deposit. KYSIDE38

KYSIDE38 - I went through a foreclosure procedure and they didn't start til we were 3 months behind, then it took 6 more months by time the court hearings, they have to send you a registered letter then you have cure time and after that cure time then they serve papers, you have 20 days from there to rebuttal, then a court date is set up..etc

Kyside - check your contract - youare trying to make a good faith payment, but I would get a certified bank check, or if your bank has bill pay have it sent though them. As for the phone attitude I would let the calls go into vm or answering machine and for every call I would call them back and ask for the supervisor.

Kyside - I was informed that there are cases where people stay in their house for a year or more before the foreclosure actually comes to pass - there are so many things that have to be done beforehand by the company, that it takes that long.

Your best bet, though is to do as advised above - send your payment in - chances are they won't send it back to you, because they most likely won't start foreclosure until you are much further behind.

My brother used to work for Wells Fargo. They used to get extra bonuses and rewards if they were able to keep the delinquency down. They could get an individual bonus based on their own accounts; and the whole office could get one big bonus if they beat out other offices.

He said they would look at all accounts over 30 days past-due, on the last day of the month. So they used to be in a rush to get the accounts over 30 to pay before the month was over. In this case, there is probably a "year end" bonus too, and they want to get you off the list before the year is over.

So they are just saying that to get their bonus. They're not going to go through all the paperwork to start a foreclosure when it is only 34 days late.
