Our company has hired quite a few people from there who left because of the conditions. Apparently the fdcpa is ignored and the management could care less. That has been told to me in almost every interview.

I think I got a recording yesterday from them. When I answered the phone, it stated they were some offices.. I didn't catch the name and to call a toll free number. I don't do that nor will I. If they want to speak to me then a person can call. I'm not afraid to answer the phone. But I think it was this CA as the name sounds familiar.

well I called these guys. I spoke with a Paul. I think it helped that I came across as being knowledgeable and asking the right questions. He was professional and didn't resort to any of the threats, intimidation tactics. I asked if they were a law firm and he said yes. I asked if he was a lawyer and he stated no. This is in regards to an old Sears account of my wifes. I am certain we made payments a long time ago but I am not sure if we paid it off. Anyway, the last CA, Ventus Capital, had the account and I sent them a debt validation letter back in November. They never responded and what a surprise, it looks like they sold it off to Weltman. I asked Paul who he got the debt from and he wasn't sure. Only that it was an old Citibank/Sears account and that it should have been taken care of a long time ago. I agree that it should have been taken care of if it is a valid debt however, I am disputing it. So once I send them a DV letter, if it does come back as good, what should my next step be? Negotiate? I may go to NACA to get a lawyer because the amount is up to $4,992 and some change. Ain't no way I can pay that off even with a settlement in the amount of time they will want. Any advice on this one? I am going to see if the SOL applies and really pin them down to providing me with detailed info including the original contract.
Oh yeah, I forgot to mention, they made numerous fdcpa violations by leaving a detailed message of the debt on an answering machine AND repeatedly calling my wife's mother, about 7 times over the last 2 weeks.

Outlaw-send those people a debt validation, too. It should include date of last transaction, etc. Check and make sure it isn't out of the SOL period. Even though it may be a law firm, they are still debt collectors. There is a law firm near me that also does debt collections. Check out the SOl thing first, and you can also put that in your DV letter..Good Luck..KAren

PostPosted: Thu Mar 15, 2007 10:32 am Subject: They just called

A James Conway, identifying himself as representing the law firm of Stanley Weinburg & Associates just called. He said he was pursuing a VISA credit card debt and needed my SSN and middle name to verify his info. I gave him nothing. It sounded like a scam. He was very insistant that I was not telling him the truth when I said I do not own the credit card he named and was in no debt. I have no idea what his angle was, but I was telling the truth. How did he get my phone number and why would he need this info if he was legitimate?

Dana- you did the right thing by not giving out personal info- you are right, if it was legit, they would have the info..Karen
