Need help in dealing with a lawyer representing Midland

I got a letter from a lawyer representing, Midland Funding, LLC (who ever they are)who is trying to take me to court! Seems that a VISA with FCNB that took a settlement payment from me in '02 has come back to haunt me...they are now trying to sue me over the unpaid settlement balance.....Is Midland Funding a "real" company? What are my recourses? Appreciate any help....

Prennie, did you pay them off back in 2002 or do you still owe a balance. I am trying to figure out if you paid off the company or not

Do you have any written proof after paying the settlement amount with the previous company? I can only think at this time that Midland Funding has purchased the remaining balance and is trying to collect on it. Did they show anything in writing about this debt?

I have recently been in court with midland funding in october of 2006 they said that i had an emerge mastercard or visa with them, i told the judge i never had an emerge mastercard, the judge ordered the lawyer representing midland to have the company send me documentation of the bills, they had until the 15th of december 2006 to send the information checked the mail box everyday I have not seen the information. I return to court on the 19th of Jan, you would think that if a company really wanted their money that they would send the information like they are suppose to, something doesn't sound right with this company. Confused

I agree that it sounds like they purchased the remaining balance of the debt. I hope that you received something in writing stating that this would be settled via the original creditor. You may want to contact the original creditor first if you don't have written proof of this arrangement. You may also want to a search in the forums about Midland Funding to see how others have dealt with them.

yeah, something doesn't sound right with this company, i received a copy of credit report so that i can have proof when i go to court, there was nothing on my credit report about an emerge mastercard or visa there was something from midland funding but it also says that midland funding closed the account back in 2005 and just now trying to take me to court. These companys are a mess.
