A collection agency.........

I pulled my credit report and noticed a collection agency pulled 2 inquiries, once in 2005 and once in 2006. They did NOT have my permission to do this. Is that legal? What recourse would I have if it is not? Who would enforce the recourse if available? If a lawyer does it, please specify an area of expertise.

CA's do not need your persmission to pull your report. If they are handling a debt, they have permissible purpose.

It is legal for a collection agency to pull your bureau as long as it is a legitimate debt. Reasons they pull your report may be to get your new address or to see who you are/aren't paying; they may even call your other creditors to see if they can get any new information that might help them collect (employer, phone #'s, etc).

If the debt is not legitimate, and they did indeed pull your credit without permissible purpose, then you can file a complaint with the Federal Trade Commission.

I figured it might be something like that but obviously I was not sure. Thank you for the answers. I asked my own lawyer, who I have paid a retainer to, and he did not know.
