ok - been going through all the info in my file for the medical debt I have been posting about. Have not gotten any response or the card yet from the dv from the ca. Here is the question. On the monthly medicine shipment, I had assistance from a non profit organization, and they made payments beyond the dates that I did. I never got any more bills from them past 7/2003. I paid that bill, then nothing after that. (thats why I thought they were just accepting what the foundation was paying them) The organization paid them until 12/2003. As I said the last payment from ME was 7/2003. Wondering which date would be for the sol? my payment or the organizations? As I said before, they kept sending meds with NO bills whatsoever until 11/2004, without ANY $. At that date, they told me I had a zero balance. Then nothing until 7/06. I am just trying to figure out when the sol would be - no signed contract, no bill with the monthly shipments - nothing. I don;t mean to keep repeating things, but I am really confused with this whole mess, and I learn more every time I post. thanks

I would think that the SOL is based on the date that a payment was made to your account, regardless of who made the payment (you or the non-profit).

I doubt that that's the case, Tiffany. If it were, collection agencies could just make a one dollar payment to the account of anyone they were trying to collect from in order to re-age the debt and avoid getting hit with the SOL. It's still an interesting question, though.

yeah that is why I posted it....I was up all last night thnking about this one. Of course my life can't be that easy...I have a bad feeling that I am going to end up in court on this one. ALthough with all their dis-organization, maybe it will be a good thing. I am interested to find out though which one would actually count.

I would have to say it would be your last payment since this is classified as consumer debt. If we went with payment a company made nonprofit or not,it would in my eyes be a commercial debt.
