I have been working on a account with Valentine & Kebartas since Jan 22. My Dell account was charged off on Jan 2nd and they sent it to them. I set up payments with them for $1000.00 and made the payments. I had another one scheduled for this week and had to call and cancle it . Now they have called me at work when I have told them not to call me at work. They told me since I was not goting to work with them on this that they were going to send in the legal paper work and file the affadavits for my arrest and that if I did not send the $3000 right now this will happen today. Well I do not have that kind of money right now these guys has scared me anyone have any advice on what to do. I have not got the first peace of mail form them yet and I have paied them $1000.00 so far .

Any advse abou dealing with this company?

Are you able to record your conversations with them? It is illegal to threaten arrest. Debtor's prison was abolished many years ago. They can take you to court and sue you for the debt, but they cannot put you in jail. Use the google search on the side of the page to read about other posters experiences with V & K.

Since you do not wish to be contacted at work, send a CMRRR letter demanding that you not be contacted at work, it is inconvienent to you. If you wish, you can also demand in writing that all further communications be done in writing.

You can send another letter requesting validation of the debt, also CMRRR.

Do Not be afraid of this company. I had a client record calls from Valentine & Kebartas. They paid several thousand dollars for the same type of illegal harassment. Don't take this from them. Threatening arrest on a Dell account is illegal. They cannot arrest you for not being able to pay a bill. Don't be afraid, be aggressive in pursuing your legal rights to stop this harassment.

Valentine and Kebaratas kept calling me regarding a $5200 Dell accoutn. Finally I agreed to settle for $3900 which they wanted all in 30 days. I agreed to but it but ended up not being able to pay it- that is a lot to come up with in one month! Will this end up going on my credit report and affecting me negatively? This Dell account was a businesst account that is 6 months past due. What happens if you can't pay- what can they do next?

It can go on your report and if they have good documentation there will be the possibility of a civil suit.

How likely is it that this company will actually file a lawsuit for debts $1,000 and less?

I'm really not sure, I guess it would vary by company and what they have set their criteria at for valid suits.

remember too that they have to have enough proof to sue, that is one (as a reminder to all) that requesting validation of the debt is so important.
