Hey I borrowed $300.00 from 10 Dollar payday loan last year and I have been trying to set up a payment arrangment with them, but have had problems. Now they have a lawyer calling me and she says that I have to pay by friday or we will go to court and they will be garnishing my wages. She says that she has made contact with my payroll people and that they agreed to set up a garnishment. Can she do that, I know that my payroll has to ask me first right? Can someone help me before I send these people money. Also, She says I know owe $535.00 is that legal to charge me that large of a fee?

Is it a lawyer? You can ask for her bar number, as it is illegal to misrepresent oneself as an attorney. If she refuses to give it out, she is likely lying, and if she does give one out, you should be able to look it up with your state bar association.

What state are you in?
How much have you paid back?

You might want to send your payroll dept and 10 Dollar PDL a letter revoking any wage assignment you've already granted. There is a possiblitly that anything you signed up for had a built in assignment.

I havent paid anything cause no one would set up a arrangment with me. And my amount went from $300.00 to more then $500. I am suppose to be calling her back this evening and talking to her about it. She gave me a phone number and her name 201-670-8851 and her name is Linda banks. The line had a whole lot of static and I could barely hear her. She started yelling cause I kept saying I couldnt understand what she was saying. I am in the state of Kentucky! I am a full time student at Western Kentucky University and I needed some extra cash to eat and school stuff. Now Im paying for it really bad.

Try to work out something with the lender so that you don't have to deal with the lawyer. If they still pursue you to pay them and not the lender, make sure that you get the debt validated with all calculations of interest charges on the principal amount. It is your legal right to confirm that the lawyer is doing legitimate collections and adding proper fees. It should be according to the laws of the state where you took the loan.

The Lawyers office just called me again and siad I have until 5pm today to pay the full amount through Western Union or they are going to file court papers and I will have to settle this in court. I dont know what I should do? What will happen if I go to court?

IF you go to court...They will either tell you to pay what you owe or throw it out..Depends on how well prepared you are...IF you go to court take all bank statments with you showing how much was deposited when your account was debited and how much you paid back...Oh and just to ease your mind..if you are from KY-Criminal Action is prohibited on PDL's worst they can do is civil suit you...Which most of them won't bother

OK, I am in KY! I have not paid these people anything cause At first I didnt think I borrowed anythign from them. But I did, and I tried to make a payment arrangment and at first they accepted. But I didnt have the money due to a emergency I had in my life. So whats the wrose the Judge will do? I can pay them half the amount today and the rest next week. But she said she will not except a payment unless it is in full.

check Kentucky's laws for the interest they are allowed to charge. If you have paid over that amount you are entilted to a refund. The threats are just that. I doubt they will actually take you to court if you honestly owe them, do set up a payment plan, but do not talk to customer service. Ask for the collections department usually they will be willing to set something up with you, Alot of times you can send 20.00 weekly depending on what you owe and pay off your account quickly.

Well this lady says she is representing Norman G Kalina a lawyer in New Jersey and that if my full amount is not paid today then they will be filing court papers on Monday morning. If they will not accepted payment arrangements then what is the worse that can happen if we go to court?

According to consumers, letters sent on Kalina's letterhead are not signed by the attorney, and the return address is in fact that of Accredited's offices, not Kalina's. Under the Fair Debt Collection Practices Act, any material misrepresentation made in an effort to collect a debt is strictly forbidden. Additionally, consumers allege that at no time did Accredited or Kalina inform them of their right under the act to dispute the validity of the debt under collection within 30 days of initial communication. Under the act, this information must be provided either in the initial communication, or within five days of the initial communication. Furthermore, the consumers claim that Accredited used intimidating and harassing tactics in an effort to collect alleged debts. The consumers allege that Accredited made repeated phone calls to them at their places of business and threatened to garnish their wages and to speak to their co-workers and supervisors. The consumers claim that these calls were made even after a specific request was made by consumers to cease these calls. Under the act, any use of intimidation, threats or coercion is strictly forbidden.
The consumers claim that the actions of Accredited satisfy this standard and entitle them to damages.

Most the judge will do in KY is tell you you have to pay them the principle amount you borrowed plus the interest which isn't too bad in KY and they will have to accept a payment plan. Smile

I just got off the phone with the original lender. They said that I do nto have to pay the lawyer people at all. I owe them $315.00 and I need to pay it by next week. And I can split that payment if I need to.

Just to let you know I talked to the Office of Finanical Institutions in Kentucky and they told me that all internet payday loans are illegal in KY. The worst that could happen is that they would make you pay the principle and $15.00 for every hundred you borrowed. It is also prhibited to rollover or renew them. Take a deep breath and relax you will make it through

Here in Ohio and all other states that I know of only a court can order a garnishment be made. You are being bluffed, They are a very shady outfit I have discovered from googling them. Don't fret until you get something from the court saying you are being sued. They have to sue you first then have a garnishment healing next.
