Westbury Ventures....Need help

I got a payday loan from them back in late summer/early fall of 2005. I got in over my head with several payday loan companies. My checking account was closed due to overdrafts. I was out of work for over half of 2006. Starting back in late fall of 2006 I started getting emails from a lady at Westbury Ventures. Now I'm getting on average 2-3 a day. They range from threats to "special offers". I emailed her and told her that I could pay 25-50 a month because I didn't get paid all that much at work. She refused saying I had to pay at least 100 if not more blah blah blah. Now I'm still getting these emails. What should I do?

Any and all help will be greatly appreciated.

Stick to your guns. If they want paid, they will take your payments. Do not agree to more than you can afford. Try and get their physical address and send in money orders or certified checks. You are lucky you are only getting e-mails and no threatening phone calls. I say stick to your guns and keep demanding they take your offer. If they want your money, eventually they will cave and accept your terms.

AHHHHHHHHHHHHHHHHH---The lovely Westbury Ventures.........I filed complaints against them because they refused to work with me and they were charging me 570.00 on a 300.00. I have paid back close to 180.00 (or so) I filed against them with my Attorney General office and last week I got a call from them saying that they wanted to settle because they received my complaint. After much of ME being in charged I am paying back "just the principal" and the remaining balance I owe is 161.00. I am paying them back in MONEY ORDERS ONLY! She didnt like that but I won in the end. Like Steelers said, Stick to your guns...DONT BACK DOWN. If they refuse I would file complaints.....

This company is such a scam. How did you file the complaint when I don't have the city and state where they are located nor an address?

Westbury Ventures is terrible!! I am dealing with them now actually. They told me I owed them $1300 and that I could make payments to them in 5 monthly installments, but the only way they would accept payment was via bank account. I didn't know then what I knew now, so I asked my dad for help since my bank account was closed due to overdrafts. The aggreenment was that Westbury would deduct $258.00 a month for 5 months. When they started taking unauthorized multiple payments from my dad's bank account I was furious!! My dad has since recovered the $380 dollars they took out over a course of two days, but I am still dealing with the "Emails" from a Marquitta Lowe "April 9, 2007

ksinansis, I got the same letter for them. See the thread "Is this illegal." I have been fighting with them all week. They are trying really hard to make my life heii. I have been given some great advice in that thread and it can probably help you, too.

Here is the thread I was referring to. What state are you in and how much was your loan for? How much have you paid them so far?

This is the email I received today:

Quote:
I am contacting you because you have one or more payday loans that have gone into collections. I have made numerous attempts to get in touch with you regarding repayment of your account(s). Since you have demonstrated an unwillingness to voluntarily settle the debt, you have been referred to Check Recovery. This automated system is actively looking to locate any valid bank account associated with your name and social security number. If such an account is found, Check Recovery will move to recover the entire balance due at once.

If you would like to have control over how and when your loan(s) are repaid, please contact me to put a firm payment plan in place. If I do not hear from you by close of business April 20, 2007,I will assume you would rather have my company take back what you owe rather than paying it back on your own terms. You may contact me by phone, fax, or email.

Thank you in advance for your cooperation.

It was quiet for a while...but here is what they've just sent me... its a Brad Ragan / Sharon Williams combo email, but it's quite polite.

WARNING: If you keep receiving emails from this address you need to respond immediately or further action will eventually proceed.

Date: 4/16/07

Case#2207-00

Dear Debtor,

At this point I can only assume that you are intentionally refusing to resolve this matter voluntarily, meaning you intentionally deceived this company. This company loaned you money in “GOOD FAITH” and funds were electronically deposited into your ACTIVE checking account. Once you defaulted on the terms of the agreement, we were forced to allow extension fees to accrue on your account. I have tried to work with you to get this matter resolved but you have consistently avoided repayment on this account. I’ve extended settlement offers, and payment arrangements but you’ve refused every attempt to acknowledge this debt on a voluntarily basis. Unfortunately I can no longer secure any unpaid cases so they will be released from my possession for further review between today (4/16/07) through (4/27/07).

This action will lead to a significant jump in the amount you owe plus further collection action will proceed swiftly. This is NOT a threat or any intention to cause financial harm but my job must be completed. If you truly want to resolve this matter in a cultured manner, then contact me with your payment information today. I understand that bad things happen to good people, but by avoiding the situation doesn’t make is disappear. I am willing to re-establish an agreement and secure this account, but I must hear from you today and a payment must be made on this account very soon. Making a small payment ($195) to put a hold on your balance is better than making none at all.

If no response is received from you then I will assume that you are giving me the authority to make the final decision regarding this account. Again, if no payment information is received regarding your account you can guarantee that I will be forced to pursue you for the full balance owed plus any fees associated with your loan contract. This is an action that I do not feel comfortable doing so please work with me. Please contact me via telephone or email to resolve this account voluntarily and prevent further collection action.

Any thoughts or suggestions as to what I can do?

sswett-I got the same email yesterday, and another one later in the day, and yet another one today. Have you overpaid them? The only difference in my letter and yours is they said if I paid them $200 then they would make arrangements with me but I only legally owe them $140 so I am making no such deal. I sent them a response telling them again my state laws, how much I legally owe, etc. and I refuse to speak to them on the phone because I don't trust them.

I legally owe them ZERO!!! The only thing about Brad Ragan is that he calls my boss. Luckily - nothing happened while I was out yesterday....since I'll be here the rest of the week, I guess I'll just let the emails fly...knowing that the phone will ring immediately following. I'm drafting something now...

HOpe you had a great weekend Sass!!
