this is a copy of the cease and desist letter i sent them :

In reference to the invoice dated November 9th 2006, Invoice Number 14796.
No one from Express Maintenance Services has any knowledge of agreeing to receive your services, nor does any person here recall making any arrangements to use a Credit Card to pay for services they did not agree to receive.
According to the memory of the owner, the agreement was made for the agent to send more information in the mail. The agent took it upon themselves to go ahead without permission from any responsible person within this organisation.
We request that you cease and desist any further attempts to collect this amount, noted as US$599.40. No contact by mail or by phone is to be made to Mr. Ryan Sobers, Or Express Maintenance Services, by debt collection agency or by Island Yellow Pages.

apartently telemarketers still haven't learnt the difference between, yes i would like u to SEND ME MORE INFORMATION, and yes i would like u to SIGN ME UP FOR YOUR SERVICES...
now lawyers are calling my boss, chasing him for payment for services he never agreed to, and refusing to speak to me (guess the guy caught on from the beginning that i know what the scam is, and how to handle it)
is there any advice you guys can offer, i'm really getting irked at these guys, its hard to try to be polite to someone who continuously hangs up in my ears and i don t have a fur lined tongue ...

my A/G ? lol ....
this is Barbados ... small island where to speak to the A/G you gotta find her in a 'rum shop' some where on a thursday night, so filing a complaint about something a US company did, illegally, is about as effective as tellin a debt collector 'my dog ate my money gram form' it will take at least 2 years for A/G to even get to the letter, and another year and a half for A/G to respond, after that, god knows how long the wait for response is...
the company is based in US Virgin Islands, i am wondering if the same laws apply to them as to the States... if they do, when the 'lawyer' gave my boss' wife the info, he was soooooo wrong, since he didn t disclose what it was for, nor did he receive permission from my boss to speak to her. he rec'd permisssion to speak to me and only me on the matter, but he refuses to do so, because i don t want the payment info, i want them to quit trying to collect on it ... Criminals!

I've been dealing with these people. The person behind it seems to be someone called David Phillips operating a number of "businesses" from Tampa. He's been told to go away but his response has been simply to clog up our fax with multiple copies of his fake invoices. The local FBI office say they can't do anything unless we give him money, which isn't going to happen. Tampa police not interested although this is clearly wire fraud. No wonder bottom feeders like Phillips carry on as they do if law enforcement do nothing to stop them

Part of the scam is to claim they have a recording. This is a lie. Their invoices are entirely fictional. I would urge anyone plagued by these bottom feeders to forward the junk by fax to Phillips' local Sheriff's office (+1 813 247 8246) until they get as annoyed as the rest of us and do something about it.

We have been contacted by the island yellow pages by phone countless times. Once in 2004 they played us back a recording of one of the conversations showing that we had "agreed" to advertising with them. At that time, they spoke to a person who spoke English as a second language and it was clearly a fast talking confusing sales pitch. Even playing it back to an English speaker it was ahrd to say we "agreed", but being that we are always carefull to pay our debts we were dumb enough at that time to pay it and ask to cancel the contract.
Now on one of the postings about this fraud I read that they even edit the tapes to show that you said "yes"!!!
I guess that labeled us as the suckers so now they are calling and calling for thousands of dollars since "we have not paid since 2004..." they even have a "lawyer" calling saying they are taking us to court. We looked up that "law Firm" and they have a 1/2 page web site saying they are a debt collection agency lending legitimacy to their scam. On their own web site it even states they are not a law firm as they claim to be on the phone. If they are getting us, I am sure they are plaguing loads more who may actually be paying them!!!

I just got a call 2 days ago from some company saying they were a yellow pages firm. First they gave me our company address which I said was correct since I wasn't sure what they were up to yet. Then they started going into something about a free listing on the internet yellow pages. After that they said they were going to transfer me to a verification agent or some such nonsense which I let them do and then they asked me a question that would force you to answer "Yes" while they were recording. I just hung up since I knew it was a scam.
