ACA Recovery Debt Collection Agency........

A Mrs. Clark from, she states the law office of Norman Kalina left a voicemail message stating that since I wasn't taking care of my debt owed to PayCheck Today that she has no other choice but to file litigation against me and that she can also call the DMV and gt my drivers license suspended and garnish my wages. At the end of the call she states I will give you until 5:00pm to call this office or we will go forward with the DL suspension and litigation with our attorney. Isn't it a violation to state they are a law office and in fact they are ACA Recovery Debt Collection Agency? Also can they get my license suspended? Please help!!!!!

If they state that they are an attorney's office when in fact they are not, it is indeed unlawful. As to the suspension of your operator's license, I don't know of any state where a debt or bounced check would result in that. I would suggest contacting your state Attorney General's office and filing a complaint as well with the Federal Trade Commission.

Kolodin - It was smart for you to post up here before calling. It can be pretty intimidating to hear threats like that and not know what they mean...and you not knowing is exactly what they're counting on. JCEMT has some great advice - contact your state Attorney's office and file a complaint. Legit debt collectors never resort to meritless threats...I like hearing about the ones where they say they're going to send the cops to your job to arrest you in front of everyone!

If you can get an attorney that will sue for FDCPA vilolations and take the case on a contingency basis I would pursue it. They will commit many other violations at 1000.00 each plus lawyers fees. Try looking on NACA.net for an attorney in your state.

Do a search on here under "Kalina." What you will find is amazing. Apparently they have borrowed his name and he claims to have nothing to do with them. There are several threads about Norman Kalina!

Thanks JCEMT and Frogpatch. I have to state the situation I got myself into. I did sign up with Oak View Law Group and was told I did not have to send a DV letter to ACA Recovery because they would. Well they didn't, now I am over the 30 day timeframe on the letter they sent me. Can I still send them a DV and Cease and Desist letter? I also am filing a complaint against ACA Recovery for stating they are a law office and stating they are going to get my DL suspended.

do as jcemt says get that letter out.never heard where you can have your license suspended for pdl debt.these places are ridiculous. Rolling Eyes

No they only way to have your license suspended is either for traffic infractions and I believe past-due child support obligations not for consumer debts.

Certain other government debts may also do that but has Ladybug stated a consumer debt should not.

Sounds like the pdl person is blowing a lot of hot air. I would research the company as well to see what there track record is....they probably have dealt with a majoriy of customers that defaulted on loans in the same way.

The reason I am asking is ACA Recovery sent me a letter on 4/12/08-OVLG never sent them anything. Now it is almost 60 days from the date of that letter. I also am going to send PayCheck Today a letter stating that I am in receipt of ltr from ACA and that I willnot send another dime to PaycheckToday or any of their affiliates, 3rd party etc. since they owe me a refund. Its a little longer than this but what do you think?

I don't know is there a particular statute that I should put in the letter. I also called NJDMV and they stated that no debt collector can get my license suspended for a personal unsecured loan, only if I had an accident and I got a judgement against me but that something that is none driving related can they suspend my license. I filed a complaint with the FTC and with my AGs office-I have 2 messages saved that they are representing a law office and threats of losing my license.

They are knowingly making unlawful threats and you have them recorded. I would suggest filing civil action against them.
