PDL Collections ACA Recovery

Today I received 2 collection letters. Both were from ACA Recovery. I overpaid on these loans. So what is the process now? Do I do a C&D to ACA Recovery? Ans where can I get a sample letter. Also do I do a DV at the same time? Has anyone had any experience with these guys? What is the best way to handle them quickly since I overpaid. I do have a letter from OKDOCC for one of the loans says the loan should be null and void. Also ACA is not licensed in Michigan. I think.

You need to send them a DV letter, all collection efforts are suppose to stop once they receive it, make sure you send it certified, return, receipt. And yes, I would also send them a C&D letter too!

Thanks Shazzers- I have 2 collections with them. PayCheck Today, I over paid by $420 and Cash Advance Network, I overpaid by $120. I will send letters on Monday. Do you have a good example? OKDOCC originally sent Paycheck Today a letter stating that the loan was illegal and to C&D any collections from me and to repay me any fees. So I guess this is what I get.

I just recieved a letter from ACA also, on a a $500.00 overpaid PDL. I sent them a C & D letter with a copy of my state's PDL laws.

Well today I sent my DV letters and I guess we will see what happens next. I imagine after reading about them they will just send me the contract from the website. However I in my letter I did ask ask that they also send me a complete payment history, and how they figure I owe another $555 on top of the $985 I already paid Paycheck Today for a $500 loan. Unbelievable. My letter also stated for them to communicate via USPS. I doubt they will comply.

S0 what is the next step after they send me their bogus DV?

I have been dealing with this company since April 2008. I have several FDCPA violations on them and I am seeking an attorney to file suit. Also found out some information on the supposedly attorney they retain Norman G. Kalina(I don't know what to believe) but he is affiliated with Helfand & Helfand Law Offices out of New York City and has an office in NJ. I will not answer the phone with them which has proved to be beneficial on my part as I have recorded messages that were left that gives me clear evidence that they are harrassing/threatening me, which are FDCPA violations. Also whoever is dealing with this company might find this interesting I found on a debt portfolios website that debt collectors sell their clients portfolios.

Oh, the website that I had found online has a lot of different companies that sale their debt portfolios its called InsideARM: Submit a Debt Portfolio. So if anyone settles with this company be prepared to have another debt collector after you. Hopefully I get a lawsuit filed against them ASAP.

ladybug - I originally filed complaints against Paycheck Today with BBB, FTC, Michigan Attorney General, and Oklahoma Department of Consumer Credit (OKDOCC). They were directed by OKDOCC to cease and desist all collections and repay my my overpayment. Apparently they did not like that so they sent me to collections. I am sending follow-up information along with my letter from OKDOCC to Michigan AG tomorrow, and plan on calling them directly to see where I can go from there. ACA Recovery is not licensed in my state to collect and they are also not licensed in their state.

I have a question about going back to the FTC. Can I do a followup on my original complaint or do I have to file a new one against ACA. I only ask because Paycheck Today disregarded the letter from OKDOCC.

The other loan with ACA is Cash Advance Network. I have taken the same step with that loan as well.

I guess what kills me is that I overpaid these blood suckers and they want even more. They are d/b/a's of MTE.

kolodin616- Did you send DV letters and C&D letters? Did they validate anything? I have not received any calls yet. Did they stop calling?

srjanes-I am seeing an attorney that advised that they would help me with the letters if needed (but I am suing them) but I have several voicemails where ACA is threatening to get my Drivers license suspended and they repeatedly threat lawsuit and refer to themselves as Hi this is the law office of Norman Kalina(so I filed a complaint with the FTC and also there is a case pending filed on 5/18/08 Apostollo vs ACA REcovery aka Norman G. Kalina aka Professional Debt Recovery services etc. in the District Court of New Jersey)-but as soon as you get any contact with them send your D&V & C&D letters. They will not validate(they will try maybe sending something dummied up) and they will not stop calling you or sending letters, just by all the search I have done on them. I did not send ACA any letters as I was with a debt consolidation co. and they were suppose to send the DV & C&D ltrs. they failed to do so. It was over the 30 days. I would have done it immediately and I advise anyone to do it right away as a precaution and a net to protect yourself. The woman who calls either calls herself Mrs. Clarke or Mrs. Garcia. She has such a distinctive voice that I just roll my eyes. The one time I called back I asked for Mrs. Garcia and the woman said hold on, when Mrs. Garcia got on the phone I stated is this Mrs. Garcia she said yes, Im sorry can I talk to Mrs. Clark that is really who I need she hesitated and said hold on and I hung up. ACA Recovery also sends their letters with the 38 E. Ridgewood address, but when I looked further, they also had or have an address with map quest and street location as 47 E. Ridgewood Ave. #3(same phone number etc.) Anyway I will keep you updated on my progress with the attorney and this company.

I sent copies of the letters from ACA to my AG today. I was told that they will be getting to my case by next week. My loans defaulted on 6/10 and six days later I am sent to collections. I was surprissed how quick that happened. I was also reading on the Michigan collection laws and it appears that out of state collection agencies do not have to be licensed in Michigan to collect.

srjanes-do not answer the phone with them and if you do and you know its them, they usually state they are from the law offices of Norman Kalina, just hang up, trust me they will hang themselves with you by leaving voicemails. Send your DV & C&D Letters ASAP. Then keep track of every time they contact you.

ACA signed for my DV letters today, I did include C&D in the letters as well. I guess now it is a wait and see game. I know there have been very bad experiences with them, I am just hoping to be an exception. I know wishful thinking. I will be away from my office next week so if they do call they will just have to leave a message on my voice mail. So if they decide to be nasty it will be recorded. Since I did tell them to C&D wouldn't be a violation anyway?

Another thing, I just do not get how a company can collect on an illegal debt anyway?
