can a collection agency come to my workplace?

I live in the state of maryland and took out a pdl who in turn referred my account to a collection agency, now, this collection agency says in will be coming to my job tomorrow. can they do this? If not how do I stop them?

This sounds like a scare tactic. I’m almost certain that they will not come to your work place. I had one try the same thing with me on an old CC. He said he was coming to my work to collect the items that I had charged. He also said he was going to talk to HR. They will say anything to scare you. Take a deep breath and try to relax.

Dear Jczplace,

A collection agency is not permitted to contact you at your office until and unless it has prior permission from your employer.

Now, my question is…Does that collection agency has prior permission from your employer?

If your answer is NO, then you may not meet the agent tomorrow even if he visits your workplace. In fact, if the collection agent visits your office to meet you without your employer’s permission, then he is violating the FDCPA law.

Now, if you feel harassed from the collection agency’s attitude then you can send a Cease and Desist letter to its address or even email address. It will be threatening from your side to the collection agency that if harassment continues then you may take legal steps against them.

I agree 100% with mommontoya , it might be one of their methods to scare you. If they call you up for the second time, just tell them that you know your FDCPA rights well and according to that they can't turn-up at the workplace. Also let them know that you'll work with them, only if they stay well within their legal limits.

Secondly, send them the DV letter and wait till they validate the debt before making a settlement proposal.

And do what monmontoya has told you to do Very Happy Just take a deep breath and relax. You're amongst the friends now.Very Happy

ok, I joined up with PDL and gave out the info to my pdls,I dont dispute the validity of my debts and would like to know how to shut this collection agency out. He is obviously trying to scare me into paying and he doesnt have my employers permission to show up at work.How do I get a cease and desist letter against this company?I have contacted my states attorneys office ,but, havent heard anything back yet.

Just send them a letter stating that they are no longer allowed to call you at work or home and can only contact you by e mail or usps.

sent the collection agency an email in which I told them to not contact my work or my home number and if he wanted to reach me, he could via email. now, He says he warned me and he is going ahead with collections full steam.heard from the states attorney and they said that garnishment of my wages was standard practice.If payday loans are prohibited in maryland and I told them not to contact my work and they do not have my employers permission to talk to them,can they still proceed with this?

In order to garnish wages a court order is needed. You can not get a court order for a pay day loan that is prohibited in your state. They are just trying to scare you.

Dear Jczplace,

The collection agency in your case is shouting hoarse because it is trying to create pressure on you so that you make payment out of fear. It is a common pressure tactics of the collection agencies for getting payments.

You may have noticed that the thunder clouds don’t generally rain. In your case too they are only trying to harass by putting pressure on you. The more you panic, the more coercive action they will take to get payment.

Most collection agencies do not do housecalls. With that being said some do.

I am giving certain information which I thought might be helpful.



A person has every right to take legal actions against a Collection Agency, if it violates any of the following: -

1.Makes a call to your office

2.Makes a call to your home before 8 O’clock in the morning or after 9pm

3.Makes a call to any friend or family member of yours for collecting debt

4.Make any false statement regarding the debt

5.Adds any unauthorized charges against the debtor

6.Address you in abusive language

7.Try to harass you

A CA can call you at work but must stop AFTER being told that you can't receive personal calls.
They can call between 9pm and 8am if you advise them that is the time that you would most likely be available to receive their calls. You work nights and sleep during the day.

They can call friends, family, and neighbors to locate you they cannot do it after establishing contact with you.

Just clarifying a few points.
