i live in Columbia SC an i have several collection agency that will not send me anything that is hard proof but they still report the debt on my credit report what do i do. i sent my letters but nothing
Equifax is the same way most of the collection agency address is not right, i can't get any justices |

You could talk to a lawyer, at naca.net who specializes in the fdcpa and the FCRA. But only if after first contact from the collection agency you requested validation within the first 30 days.
The other thing you can do is what I did. I sent the letter and disputed my credit report after 30 days and it came back verified. 30 days later I disputed it again, same thing. I then waited 5 months disputed the entry and it was removed, and this was one of the worst debt collectors in the industry. Give it time cause right now a lawsuit against them is pointless, there are not enough violations. Let them really break the law and make it suit worthy. Better yet, if they sue you, counter sue them and it saves you the money to file a suit against them. SAVE YOUR EVIDENCE!!!!!!!!!! |

I just went through the same thing. I had Voicestream in 2002 and canceled it. 2 Months ago I received a bill from AFNI for a T-Mobile account. AFNI and T-Mobile both refused to provide validation of debt.
I wrote to their main offices in NM and WA along with filing complaints in numerous Attorney General's Offices. Check out Rippoffreport.com |

My attorney has succesfully sued AFNI several times. They consider settling part of the cost of being scumbucket business.

I just recieved a letter from AFNI regarding a debt with Verizon dating back to 2001. Despite the fact this debt was resolved in 2001 when I moved, they demanded verification of payment. I told them I do not have any records dating back that far as I destroy records after 5 years according to IRS Rules. I also understand this scenario is is not unique and many others in various states are receiving these letters too. It appears this is a new form of extortion used by companies and collection agencies in rough times. In my case, they also ran a credit search on me to obtain my SS# and correct address which is against the law without your written permission. So, if anyone esle is aware of this happening to them too, when you send the letter, let them know you are aware of this and that they are in voilation of the law. I hope this helps others and this company will soon be a memory.

I have TWO things on my credit for the same account from AFNI. It's for a Nextel account I never had. I've disputed them like 3 times and each time the dispute comes back as "has been verified that this item has been reported correctly". In other words, the CA said "hey is this reported right?" and AFNI says "yep" I haven't had a nextel phone in 9 years and when I left I had a zero balance. I'll be submitting my debt validation letter to them today.

Kevin...have you ver recived any wriiten correspondence form AFNI in the past or did you just discover their entry on your credit report? What state do you live in? You stated it is for a Nextel account you never had but had a Nextel account 9 years ago?

SOL depends on your state and goes from the date of last payment you can look up your state here....
http://www.bcsalliance.com/y_debt_sol.html The amount of time to report on a credit report is different. It also goes from the date of last payment plus 180 days I think, usually 7.5 years is the max it can stay on your credit report. |
