I was just notified by my credit monitoring service that EquiFax posted a negative account on my credit history and the report supposedly came from ANSI. Since it appears well known that this firm is not reputable is there any liability on the part of EquiFax for allowing them to post erroneous information? I want to sue the jerks with the deepest pockets.

In order to sue for FCRA violations I am pretty sure you need to dispute the debt and entry first. If they verify inaccurate information, that is when you can sue them. The violations can be confusing so I think it is best to get a good attorney familiar with the FDCPA and the FCRA. They will get the maximum allowed.
To find an attorney in your area, go to www.naca.net. The most you might have to pay is the filing fee to sue them. You get that back if you win and the debt collector pays your attorney fees. |

I just received a bill this morning and couldn't even think of ever having an account with qwest! I finally remembered the nearly five year old landline I had with an old boyfriend. they only wanted half to call it good! Wierd I have never been given a collection call or letter until now, and decided to google afni! I'm glad I did!
The letter said to go online with my account# and last four digits of my social. But, no info as to time frame or address I lived in over four years ago! How did they find me? I don't even have the same last name anymore! Do I have to do something about this scam in the form of a small bill to fix my credit? How do I go about this |

I just paid off a old telephone bill that AFNI claimed I owed. I asked them to send me my last bill to validate the debt. I just couldn't remember being that it was a old residence. I did call the local telephone company just to see what they had on record. Turned out they were able to confirm what AFNI was claiming. I ended up settling on the debt BECAUSE it was showing up my credit report. From my experiences w/AFNI it seemed to be valid. I hope this helps somewhat.

My line was through QWEST too. To be honest I don't even remember having a old past due account or getting anything from Qwest. It is a old account, but like I said I called Qwest right away. They did confirm that I owed a balance and that it was sold off to AFNI for the exact amount. I would call Qwest asap. They should be able to verify what you may or may not owe.

I was doing a research on a different agency, but decided to look up AFNI as well. They actually came up. I guess they are licensed in my state...Oregon.

while they may be licensed.they have been fined and reprimanded in IL for there actions.so don't be shy about filing complaints.

I just received a collection letter as well for a Verizon bill. This was from 2002 in Buffalo NY, I called to find out what it was about and they told me it was for a line that started in June of 2000 and was disconnected in Jan. of 2002. The best part is I have lived in Rochester NY (just over an hour away) since March of 2000.
The odd thing is I did live in Buffalo for most of my life and did have a landline with Verizon until March but it was a different number. So I am not sure if someone when through my trash after I moved and somehow found my SS# or what. But I have sent a letter to dispute the bill along with a copy of my lease for when I moved here to Rochester. I will update this site after I hear back from them. |

Have you pulled your credit reports recently to look for other signs of fraudulent activity? You might want to start researching Identity Theft as well. If this is indeed IDT, you need to get moving on it so you can get it off your reports.

The notice I received from AFNI has 404 Brock Drive PO Box 3427, Bloomington, IL 61702-3427. So would I send it to the physical address or to the PO Box? If I send it to the PO Box, they won't be able to sign for it, would they? I also looked them up at BBBOnline, and the address they have is 404 Brock Dr Bloomington, IL 61701-2654. The 30 day mark is coming up, and I don't want this to go to the wrong address.
Also, Nascar Devil, I live in Texas and was wondering how do I reference Chapter 392 of the Texas Finance Code? Do I just state that according to this, you have to post a bond with the Texas SOS? I tried to look them up via your link, and didn't find them there at all. Thanks! |

Here's AFNI's bond info. The SOS website is kind of tricky. Type in the first couple letters followed bt % and then hit search:

So, is it safe to assume that the address found on the SOS site, which is also the same one on their BBOnline Profile is the absolute correct address to send the letter to?
Should I be safe and send multiples, one to the 61701 zip, and another to the 61702 zip? The PO Box? |

SOL depends on your state and goes from the date of last payment you can look up your state here.... URL deleted per TOS - ND The amount of time to report on a credit report is different. It also goes from the date of last payment plus 180 days I think, usually 7.5 years is the max it can stay on your credit report. So if I had a bill from 2005 and I have been disputing it ever since then under SOL can I get it removed. I had Sprint long distance but Verizon blocked the service so I canceled with Sprint and they continued to charge me for three months, I called Sprint to dispute it and told them to check their records and see that the service had not even been used. They claim it was my responsibility to verify that it had been canceled when I requested it. I said my verification that it was not came when I received a new bill at which time I requested again it be canceled. It was finally canceled by them for non payment three months after the initial request was made. |
