It is my understanding that the SOL in CA is only 4 years. I am confused. So, I guess my real question was since it shouldn't have been there in the first place, what can i do to get it removed? I have tried going through a dispute with the Credit Bureaus. Didn't work.

SOL is the time limit to file a lawsuit, has nothing to do with the time limit on reporting. In every state the credit reporting period is 7.6 years. You will have to send debt validation letters to whoever is on your credit report that you know you don't owe. Then after that, dispute it with your credit reports in writing. KENDALL<<< You most likely will not get it removed, it will show paid charge off or similar till the credit reporting period of 7.6 years is up. |

Kendall....dispute it with all 3 CRA's anyway. The worst thing that could happen is it remains but will show as disputed by consumer.

I have recivied a letter from AFNI, they want me to pay 710.00 for account that i had 8 years ago with tmobil and it was paid, i havent recieve any letters from tmobil nor any collection agency for 8 years and now they are bugging me with this crap. What should i do?

AFNI has been calling me like crazy the past month and a half, everymorning my phone rings between 8 and 830...but I just noticed that they recently showed up on my crecit report saying the date opened on the account is 1/01/09, even though it's for a 7 year old Tmobile bill they're trying to get money for...any thoughts on how this will affect me? or what I should do? Thanks in advance!

i have dealt with these nasty people before - for phone service i never had! i chalked it up to being part of my identity theft case, and added it to my police report, etc (they never reported me on my credit reports and left me alone since than) but now reading this stuff, i am not sure..

So, I received a letter out of the blue from AFNI stating I owned over $1k to T-Mobile. I did at one time have an account with T-Mobile, but I know that I honored my full contract with them, and I never received any correspondence from them after the fact. This had to be 6 plus years ago, so I sent a full DV letter asking for full details proving why they are claiming I owe this amount.
Within about three weeks, I finally received a "statement" that does in fact have my address at the time as well as my old phone number, seemingly from T-Mobile for the full amount they are claiming that I owe. Which at the bottom states, "This image was generated using a template provided by T-Mobile and your most recent billing data." They included nothing that I asked for, which included a copy of the original contract, a summary of charges that amount to this ridiculous amount, complete payment history, fees & interest that may have been tacked on, etc. What should I do at this point? There is no way I am paying them anything without detailed proof from the original creditor, especially when I know I completed my contract with T-Mobile. Can I contact T-Mobile directly, would they be able to provide me with any definitive details at this point, or would they force me to deal directly with AFNI? Should I send a second DV letter? Unfortunately I didn't keep any old statements to prove this. I appreciate any advice, thank you in advance. |

there are only certain states that have a statute of limitations on collecting a debt and chances are none of you live there. perhaps you should learn to read. statute of limitations refers to credit reporting and taking someone to court. NOT collecting a bill.

Actually, it's called a Statute of Repose, A$$ Clown. Only 2 states have those. MS and WI. ALL state have a Statute of Limitations. If you're going to submit a post pushing your superior intellect, at least get your facts straight...Tool!

Like many other people here, I just received a settlement offer letter from AFNI for a T-Mobile acct that I never had. I live in Florida and was told by AFNI that the acct was from 2002. When I told them that I never had a T-Mobile acct they said that they had no other info for me. What exactly do I need to do at this point to make sure it is not on my credit report when I refi my home in October?
