I received a call this evening from AMO. The girl on the line told me that she was trying to collected a debt for a Target card that I have. She claimed that Target had turned this account over to them for collections. I asked her for a debt validation and she told me that I had received a notice from them and they did not have to validate this debt. What they sent me was not a debt validation. She also told me that they would not work with any debt management service either. Anyways, after sitting here and thinking I called them back at the number they gave me and got a different lady on the phone. She said no, that Target had not turned over my account to them, that she was basically working for Target and she had access to all my info--every purchase, when the card was opened, when I had made my last payment, etc etc. She also had all my banking information from when I had made online payments to Target. Is this a secondary debt collector or is this really Target trying to collect on their credit card? I am so stressed over all of this I don't know what to do or where to even start. Any and all helpful advice and info would be very much appreciated!!!!

In response to your post, Your account is up for review when the call is made. So when you get one of these ladies on the phone they are telling you the truth. Basically you have options. Balance, balance with late fee's removed (you can have up to 3 late fee's removed on your account per year(this is target's rule) or minimum due. You have to let them know what your situation is. Basically, hear them out and let them know what is really going on. Most of the time they are kind and knowledgeable. If one of the girls are giving you trouble. Ask to speak to their Manager.

AMO recoveries works directly with Target on you're account to assist you out of collections. Target wants to keep you with them as a card holder. They do have access to your info but listen, they are good people and only trying to help you. If you do get someone rude just say I want to speak to your manager and let them know what they said, their name and how they said it.

Don't Stress out. They are there to help you get out of debt any way possible. At this time, they only do Check over the phone so make sure you have a valid account number and routing number. It would help to just void out a check with all the info on it that way you have a record of it too. If you need more time just let them know, this will help them as much as possible. I just paid my target card off with them. Albeit, it was about 400$ but they reversed some fee's and got it down to about 300. They were really nice about it all and even gave me a confirmation number which I later called back in and made SURE it was in the computer for the date and amount I said.

Just work with them and they'll work with you.

The above guest sounds a bit suspicious. NEVER give your banking account info over the phone! It's better to send them a money order via the mail. Don't let them tell you that it has to be a check-by-phone.

Call Target directly, ask them to confirm what the caller told you.

A further note...

Never, ever agree to pay someone during a phone conversation when you have no idea who they are. OK, they have your account info. But, do you know if they are legally allowed to collect the debt? They are required to provide you with proof IN WRITING before you pay them.

Write down the company's name, ask for an address. If they will not provide an address, ask for their phone number if you don't already have one. You can then google the company name and/or phone number to get a mailing address. Or post the company name and/or phone number hear, we can help you find an accurate mailing address.

Only communicate with them via writing, and make sure you tell them (again, in writing) that all communication must be done this way, not via phone. That is your legal right.

Every letter you mail them, make sure you sent it certified return receipt, and hold onto the signature card you get back in the mail.

AMO is a third party and so subject to the fdcpa. Hold them to it. Is this a fairly recent issue? If so, I would go straight to Target and attempt to work it out with them. If the account is only a few months past due and not charged off, Target may be more willing to work with you but you need to keep the line of communication open with them and let them know your situation. If they insist that you deal with AMO, then follow the advice above. If they call, verify your mailing address and tell them you expect to receive their dunning letter w/in 5 days. Then follw the DV process.

AMO is a 1st party collection company and yes we are subject to fdcpa. I say we because I work there now. Check by phone is prefered because if you set up your payment on the phone you can get some fees removed. They are a legitimate agency unlike what was written above. We can waive up to 3 late fees in a year total, per Target rules. You can also mail in payments into Target Financial or walk them into a store. We don't like these options because when we call somebody and they say that, most of the time it won't happen, it is just an excuse to get off of the phone. Also, some people here are really scandalus. You will not go to jail if you don't pay, you will not have things garnished if you don't pay. We can't do that.

I you go to the end of the 6 month deliquency, it gets turned over to a 3rd party collection agency. They will want the balance in full and that is it, no late fees removed. And they are the ones that can garnish your wages. If you let it go past 6 months, it puts a R-9 on your credit report. Don't listen to people say that you can't walk in a payment. I hear people say that all the time and it is bs and illegal.

The bit about the dunning letter in 5 days is straight retarded. Mail can take longer than 5 days to get from coast to coast. You do have the right to validate your debt but you have write in within 30 days of your first contact with them. Look up the FDCPA laws and it will tell you more. Remember, if you do owe a debt, just go in store and pay it off sooner than later.

If you want your debt resolved we can help you but until then listen to the people on this site telling you not to secure it w check over the phone. Best bet is to contact AMO and talk to them. Ask for a supervisor or better yet ask for a manager and they would explain to you all the information you need.

First party....third party...its all a bunch of nonsense to confuse the consumer. The straight fact of the matter is that all Collection Agencies MUST comply with both federal law and any state laws if they are collecting from people who live in that state.

Federal law states that a letter MUST be sent out within five days of first contact....NOT that it has to get to the debtor in five days, but that it must be MAILED out in five days....big distinction.

But regardless, if it is a collection agency calling and NOT in house collections (and by in house I mean collectors who are employed BY Target, not a collection agency hired by Target) then they have no choice..they must comply with said laws and they HAVE to respond to a DV request if it is timely 9and some states have debt collection laws in which there is no time frame, a debtor can ask for validating documents any time, Texas is one such state..not sure about the others).

Don't give anyone your bank account info. If they call, verify you are the consumer they are seeking, verify your address, inform them they have 5 days to send you details of the account and end the call.

I don't even have a credit card from target. someone gave me a gift card from there and that's about it.
