id love to see what you would say if u had the balls to talk to them in person! Also your point eludes me, why would you tell me I'm in the wrong forum? I think I'm in the right forum, we are discussing collection agencies and I am discussing topics pertaining to the fdcpa. It seems to be the right forum to me. |

I notice SHE never responded to my post..I wasn't attacking, just pointing out the inconsistencies and downright wrong information. Curious that she never responded.

I received my DV letter from Asset Acceptance and I am totally disappointed. It only states the original creditor and original account, my name, the balance on the Asset account, my address, and my last 4 digits to my SSN. This is clearly a brief DV letter. I wanted one more detailed. Should I contact the original creditor myself to see if I can find some more info on it (i.e. transactions, open account date, where this card was used)? They clearly didnt take my letter seriously because after the validation they are still trying to collect payments on this account. I refuse until I see some more information. The balance is horrific. It is a whooping $7276.41. Thats a used car for me.

What this clearly is, James, is a blatant attempt to sidestep validation entirely. That's about par for the course with Asset, from what I understand.
Lemme guess... It's something they printed up in-house, right? Maybe on their own letterhead? That doesn't make the grade for validation, my friend. Proper validation requires the collector to obtain documentation from the original creditor, then send it to you. See this FTC opinion letter for a good explanation. In your place, I wouldn't worry about contacting the OC, unless the OC is contacting you. Asset likely bought the account from the OC. The OC probably doesn't have anything on it anymore. If Asset could have gotten the info from the OC as required by law, they likely would have. Document their continued collection activity carefully. Continuing to pursue collection activity without providing proper validation is an fdcpa violation. You can sue for that, BTW. __________________

Luv ya, Unc...
I don't moderate in this forum, so I can't delete posts or lock this thread, but let me remind everyone of the terms of service: Attacking posts of any kind will not be tolerated. We are here to help each other get out of debt--and will absolutely not tolerate anyone bashing anyone else. If a collector has something helpful to add to the discussion, we will welcome them, otherwise we ask that they stay away. Posts like "just suck it up and pay your bills, lowlife", are definately not welcome here. |

And yes the validation was printed on their letterhead. It was very simple and brief.

It sure doesn't Wulf. It isn't detailed at all. I will just send another validation letter to them to see if I can get some kind of clarification because this is ridiculous. They dont even show up on my credit report and they are still trying to collect....

Did you send them the validation letter that was under the community resources topic with the enclosure?

That would be this one, James:
http://www.debtconsolidationcare.com...structure.html The Wollman FTC letter is the enclosure that goes with it. It's JCEMT's letter, so he obviously likes it. I've used it myself with good results, so I'm kind of fond of it as well. __________________
