I got a validation letter from asset acceptance like i requested. It doesn't have a last payment info on it, but I know it is out of SOL. They are now saying that they are suing me and that I have been served when I called them. The problem is, I never received any papers. They have my address now (lived here 3 years), but could they have filed somewhere else?

How do I find out if they really filed suit or if they are full of it? Do they do it in county courts or small claims or where do I call to verify?

Call your local courthouse district and small claims.Keep a close eye on them dirtbags they like to use improper service to get illegal judgements. If you have proof that they made a legal threat they could not complete,get a lawyer and sue them now!

I live in a city with in a county, should I call the county court house or the city municipal court house? Also, should I maybe call the court house of the last city/county I lived at?

I can't believe they could get a default judgement if I have never been served!

A real court case will issue summons delivered by the sheriff at your mailing address. Call Asset Acceptance and inquire about the legal case. They must let you know the court if this is legit.

That is helpful. I really appreciate everyone's help. I am starting to feel better about answering the phone now that I know what to say. I feel empowered being able to ask advice from knowledgable people in this website.

you give great reasonable advice but I disagree with calling Asset or believing anything they say. Look up their record with this website,ftc,bbb.Please don't take what I say personally. I just have a different point of view.

How will I be notified if they receive an illegal default judgement? I just don't want something so far out of SOL to get an illegal default. I would pay but the debt amount is wrong also. I got the DV like I said before but it is not right and I am not going to admit ot anything to restart the SOL.

These people are frustrating. Someone needs to put them in their place. Maybe these companies are scared to give an actual address because someone may go crazy and pay a visit with a gun. They lie and decieve you till you are almost at your wits end. Without this site, I may have had it a long time ago.

You will not be notified about judgement obtained illegally. That is why I said to check local courts,all of them.I would add to check courts in any area where you ived previously.

I fully agree with what you are saying, cajunbull. And I know Asset Acceptance has more negatives to their name. But one should not think on the basis of this info only. Just imagine, what happens if there is really a legit case against this poster by Asset Acceptance. And if he is not getting any info from anywhere, it doesn't harm to call Asset for knowing the case. I will think twice when realized that Asset is not telling anything about the case. But if they have a legit case against this poster, they have no reasons to hide it from him. But if they don't tell him, it might be because of not wanting him to show up in the court. Anyways, one call will solve most queries. Be it Asset Acceptance or any other collector.

I didn't take your comment personally, because of the fact that there was nothing personal in it. You have a point and you posted it with your thoughts. I ran my thoughts on this issue. Ultimately, the important point is that the original poster gets the benefit from our info.

I would do just as cajunbulldog said and check any and all court where you currently/previously lived.Also if they did get a default judgment against you it should be listed in the public records section of your cr. I would keep a close eye on your report to see if they have or may get one against you in the future.
