Theft by deception

I had a collection company call person said he was an attorney liaison for company and we were going to be charged with theft by deception when my husband called back and couldn't pay the amount this man wanted the man said we would be charged and hung up on my husband. Has anyone heard of theft by deception? we tried to return the item to the company they wouldn't take it.

I have heard of it with bad check writing

Hi, Trish, welcome to the forums!

Do you mind sharing a little more about this situation. What collection is calling you, what item are they referring to, and who is the original company? Is this for a payday loan?

Also let us know what state you're in. If the "law office" is trying to collect on a debt there are certain laws they have to follow, so please remember to stand your ground when they call. You may also be entitled to recording the call, but that depends on what state you live in.

It is major financial, I am in ohio, and it is a sweeper and air purifier.

Yes we purchased these items. We made payments then things happened and we were unable to keep up with payments so we tried to return items they wouldn't take them. We purchased in Feb. tried to return in april.

Were these items purchsed from a catalog credit card that requires an active checking account?

Also, is Major Financial the "law office", or the company you obtained the items from?

No they provided financing and major financial is the loan company. Tristar is company we purchased from and Major financial gave us the loan. No credit card or checking

To be honest between this and my payday loans and couple other little things i'm just ready to file bankruptcy my credit can't get any worse than it is now. I give up!!

I think you're being a little hard on yourself. There are ways, easier than giving up, to help get your credit back on track.

Have you reviewed your credit file recently? Depending on where your credit stands, you could seek the advice of a credit counselor. This site offers a free consultation with a debt consolidator which would be a better alternative than declaring bankruptcy. You're already a member of the forums, but did you fill out the form for a consultation?

And as far as Major Financial goes, I'm surprised they are giving you a hard time, and not working out better payment arrangements. They have a good standing with the BBB.

For the payday loans, were these storefront or internet loans? What are the companies, and how long have you had the loans?

payday loans are store fronts. advance america,cashland, 1st ntl, money mart, capitol cash, cash connection. They were current until this past friday i couldn't pay. I've been in the cycle about 3 months.

Theft by deception is just a fancy way of saying fraud. Signing up to by a sweeper on credit and defaulting on the payments is not fraud. You can not be criminally charged for what you did. The creditor is just trying to make you think that to scare you into paying. They could sue you though and win. I doubt they do that though. They will probably just leave it on your credit and harass you over the phone and wait for you to settle when you try to get a home loan or auto loan.
