Bayside Asset Recovery have threatened my wife via voice mail. She happens to have a PDL with ACE, I know that it is owed. But they have yet to actually speak to her, but told her on her voice mail that her license was going to be suspended, and they if she doesn't pay ACE she is going to have problems wished her the best of luck and disconnected the call.

Is it not the case that leaving details on a voice mail about the debt is now a violation of fdcpa? I already know that a direct threat of any sort is a violation, but voice mail is now considered a third party right?

I got a voicemail on my phone from someone who said their name was Julie Adams and that she was "scheduled to serve me court papers at my address" and that she needed to get these papers in my hand today. She proceeds to say that I have 1 other option I can call Bayside Recovery and speak to their legal department blah blah. At the end of teh message she goes on to say I should consider myself notified. what a load of crap. Firstly a process server does not call to tell you that they are trying to serve process. Process must be served in person by a LEO or a officer of the court. you cannot be notified by telephone. Secondly, If a civil judgement is in process, why would they be giving you a "second" chance to take care of your debt. they have already decided to seek relief through the court. This company is shady at best. I urge everyone that deals with this company to contact the FTC.

The blame goes both ways moron. The predatory creditors and lenders give too much credit to people who should not have it. Then on top of it they jack up interest rates because a contract says they can. So people sign up for 5% interest and are suddenly now paying 32% interest. Thank Bill Clinton for that. Same goes for houses. People can say they make $80,000 just to get a house when they only make $30,000 a year and get trapped into balloon payments. Furthermore someone should not buy a house if it costs more than 20% of their income, Clinton allowed the banks to let people use over 35% of their income and they get stuck.

Most Americans are not as smart as you. They put too much trust into the system and get screwed. Clinton allowed for honest Americans to be taken advantage of. The problem is the democrats, Clinton, Barney Frank and congress just to name a few.

Mark my words, In a few years, Barney Frank WILL be in jail.


The other problem is people fall on hard times such as myself. I was stricken with cancer 2 times in the same month. I have been fighting on and off for over a year. Do you honestly think that I purposely don't want to pay my bills? My health is more important and food shelter and clothing are next on the list. The last thing I care about is a $200 I charged on a credit card. They make that back in less than a minute. Yes I used the card, yes I owe it, but there are more important thing to worry about.

I honestly don't think the fee is the problem, I understand they have to make money to stay in business. I think the fact that to many take these loans out and can't pay them back is the problem, if you borrow 500 this week, and you seriously don't have any idea how your going to pay it back, "on a wing and a prayer" adding another 20-50$ in my opinion doesn't really matter. You don't have the principle let along the loan amount.

If a person can really pay it back after one borrow and be done with it, that is wonderful.

But we know that is not the case in most situations. Most everyone gets trapped into re-borrowing cause they couldn't afford to take the money out in the first place.

Along with the rate change the payback time was suppose to change and the amount of total loans you could take out in a year was to be limited also. Fortunately I've not been in a PD store since last year, so I don't know what really is going on.

In reference to my above post. I just hired an attorney and am filing suit against this company. Their conduct amounts to unconscionable conduct in SC. I urge everyone who this company is harassing to file similar law suits in your area. I may not win or even if I do any monetary winnings will be sucked up by the lawyer, but at least I can hit these asses where it hurts. In the Wallet!

I just filed a complaint with the FTC-they called me before 8am this morning, couldn't understand what the lady was saying. Then said I had one chance to take care of this, gave me a "docket" number and the 800 # to Bayside. Then said I should consider myself served. I called the number and got the "legal" department. When I asked what this was about 1st they said I had been processed. I told him no-then he told me the amount and said that if I paid that he could call the process server and rescind the papers. I paid the amount owed immediatley. Only after did I check the court website, and there was no case filed against me. I am concerned.

I started getting voice mails from BaySide Recovery. They stated that I had written a bad check and that this was serious. They tried that ploy to have me call them. The truth is that I never wrote a bad check EVER! Next they stated that I had been warned and this was the final call. I should consider myself served over the phone. Before this I was getting calls from India stating that I was a Michael McGerty and that they were calling to collect some debt. This has been going for a regular basis for over 5 months before this "gruff voice" began leaving messages from BaySide Recovery which is located in Alabama.

They never state what the debt was about or who made the claim in me. These calls from Bayside Recovery have been continuous with threats if I did not call them.

I am going to contact the FCC on this Company. This is just another example of how the poor middleclass gets attacked while the Government pours Trillions of dollars into the pockets of the wealthy and congressional lawyers who stole from the American People...then when the fireworks begin, they will all be astounded to discover that we are no longer going to take this crap from the employees of Bayside Recovery. Getting to Alabama is easy and presenting ourselves is easy as well...Don't wait...I am not going to take it any more!

Next time they call, verify you are the consumer they are seeking, verify your address and tell them they now have 5 days to send you details in writing. End the call. If you want to file complaints, start with the FTC, your AG, Alabama's AG and the ACA if they are members.

let's work together to file a class action law suit against this company, because they are calling my job as well and leaving personal and valuable information on my voicemail, with co-workers, and etc… They are harassing my family and threaten to serve me papers. I requested documents from them and they said I should have them. They are rude and disrespectful.
