Okay I had a CA call me last night on my cell phone. It was 9:35 here in Georgia but 8:35p at home, when I take my cell to a new time zone, do they have to follow that time zone CRA statue?

Hmmm...interesting point Ashley. But how would the CA know that you are in a different time zone with your cell phone when they call?

So they don't know its a cell # so they have to follow the CRA as I just give out one # and don't say whether its cell or land line, its the only # I have

Well, I would say if they don't know it's a cell phone and they think they are calling you at home, they would be in violation of the FDCPA or CRA - specifically the section that states between what times they can call you.

Ashley---they technically don't know where you are, but would assume you were home right?--SueBee, why would they be in violation of FDCPA or CRA? I know it has to do with the time--but I thought it was 9:00 in whatever time zone you live in.

You know, I think you may be right, Lorri. FDCPA says no calls before 8 a.m. or after 9 p.m., but I'm pretty sure if they thought they were calling Ashley at home, in her home time zone, it would have been before 9 p.m., per her original post here.

I stand corrected! Smile

Please don't give me that much credit---I didn't know I was correcting you. I was just trying to figure it out. Remember I teach 2nd grade for a reason!

LOL - oh come on Lorri! You always post useful info here, and you're a great help to many.

But I have to say, you keep me chuckling when I'm up late at night sometimes. The soap opera thread we had going earlier was hilarious!

Thats my thing---always keep 'em laughing. I was kinda cracking myself up with the soap operas. Thats the other thing about me---I am kinda one of those comedians that have a kind of inflated EGO when it comes to my own material. Laughing My mom (who is quite used to me obviously) always says quit laughing at your own jokes.

It goes by where your area code lies. If they're on an auto-dialer, the system figures it out automatically. I use receive all sorts of crazy telemarketing/sales, and those pesky buy-my-vacation-package calls when I had an LA area code, and moved to Michigan.

It's area code and I also think address! My daughter lives in Santa Monica, CA and her cell phone has a Boston AC (where she used to live). From what she says, the calls she gets reflect West Coast time.
