No, they aren't legal. Inform this collection agency that the debt for which they are attempting to collect on is ILLEGAL. Did you receive this notice as an email? If you did, you got them on an FDCPA violation, click the link below to read about it.

A dunning letter (the first point of contact) is supposed to include-
"This is an attempt to collect a debt from a debt collector, if you dispute the validity of this debt you have thirty days to request validation."

what FDCPA violation is it? And yeah I got it by email. I think it's funny I got two loans from these people they're two "separate" places but come from the same email address. I also got a phone call about one of the other ones that I didn't apply for and they wanted me to call back today. I didn't get done with work til 11 pm so I couldn't call back.

Ok so United Cash Loans sent the following:

09/02/2009

(to me),

UnitedCashLoans regrets to inform you that our ACH debit was not honored by your bank, and was returned marked “for review”. As a courtesy to you, our valued customer, we are extending an opportunity to amend this oversight.

As of 09/02/2009, you remain in collection status with UnitedCashLoans. Although we have previously contacted you about your delinquent account, we have received no response. You must make arrangements to settle your account.

Please contact our collection department at 1-800-354-0602 immediately, to make payment arrangements. If we do not hear from you within 48 hours, your account will be referred to an escalated collection department.

In order for your payment to post to your account properly, please include the following code: EM501
Certainly, your continued good credit standing with our company is important to you.

Thank you for your prompt attention to this matter.

Sincerely,

Customer Service

What doe sit mean an escalated collection agency? Again, I'm from Pa and they're service itself is completely illegal isn't it? I tried to write to one of those free lawyers but never got contacted. I don't know what to do. I'm sorry if I sound stupid, I really have no idea what i'm supposed to do though.

Contact your bank immediately, and inform them that you are the victim of fraud.
