I received a call at work from a collection agency for Payday Loan Yes. This is the third time they called me at work. This time his name is Joe. He actually told our receptionist why he was calling. How embarrasing. I sent them TWO cease letters. I sent them to Payday Loan Yes. The guy that called did not identify where he was calling from. I looked the number up on google and it's some sort of collection agency. He is threatening me with fraud and wage garnishment. Is there anything I can do?

I sent two letters to the pdl place, and sent a copy to the PA State Attorney General's office. I also filed a complaint on the original person who called me and the AG's office sent me a follow up letter telling me that they are going to look into the matter.

you should hire an attorney and sue them for violating the Fair Debt Collection Act.
I did it 10 years ago and made out

That sad part is, beside you guys in the wonderful community, nobody else knows. Not even my family. I am so embarrased about the entire situation. I am seriuosly considering filing for bankruptcy. A family filed back in October and she wants to help me financially, but she wasn't sure how long after bankruptcy she could apply for a loan. Sadly again, she thinks it for credit cards only. I can't even tell her and she's my mother.

Bayley. . .yes it is sad but I would bet you dollars to donuts that most of us on here were or are in the same boat. Nobody but this board knew about the position I was in. It wasn't until I cleared all 5 of my PDLs that I finally told one other person. I probably will never tell another sole. We are here to help each other. Chin up. Things will improve. . .promise.

Which collection agency is calling you? At this point, you need to send the Debt Validation letter that include a cease and desist clause directly to the collection agency.

This letter is being sent to you in response to a notice sent to me dated <DATE> Please be advised that this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.
This is not a request for "verification" or proof of my mailing address, but a request for Validation of Debt made pursuant to the above Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.
Please provide me with the following:
1. What the money you say I owe is for
2. Explain and show me how you calculated what you say I owe
3. Provide me with copies of any papers that show I agreed to pay what you say I owe
4. Provide a verification or copy of any judgment if applicable
5. Identify the original creditor
6. Prove the Statute of Limitations has not expired on this account
7. Show me that you are licensed to collect in my state
8. Provide me with your license numbers and Registered Agent
At this time I will also inform you that if your offices have reported invalidated information to any of the 3 major credit Bureaus (Equifax, Experion or TransUnion) this action might constitute fraud under both federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent, I will not hesitate in bringing legal action against you for the following:
1. Violation of the Fair Credit Reporting Act-reporting inaccurate information
2. Violation of the Fair Debt Collection Practices Act-continuing collection activity on a debt which has not been validated
Also during this validation period, if any action is taken which could be considered detrimental to any of my credit reports, I will consult with my legal counsel for suit. This includes listing of any information to credit reporting repository that could be inaccurate or invalidated or verifying an account as accurate when in fact there is no provided proof that it is.
REQUEST FOR CEASE AND DESIST OF CONTACT BY YOUR OFFICE: I would also like to request, in writing, no further contact, either in writing or telephone be made by your office to my home or to my place of employment, unless it is to provide validation or release of liability of the debt.

Hi Vollyball Mom....He did not identify the company name all he said was "This is Joe and you committed fraud. Payday Loan Yes. We gave you money on 2/22/08 and you have not paid us one dime. You committed fraud man. If we do not hear back from you, we will garnish your wages. I am not trying to be mean, but this is my job" and left an 800 number, which I think I left at work. The embarrasing part is he told our receptionist why he was calling. She put him through to my voice mail and sent me an email saying "payday loan message in your voicemail". I was so embarrased. I told her what happened and to not tell anyhone.

did you send the letters that volley gave?if not do it asap.if so start keeping track of activities like that one.you see PAYDAYLOANYES got the wood put to them in illinois to the tune of 250,000.00 for illegal collection tactics like that.get your ducks in a row,send your letters,take action.

I sent Payday Loan Yes two cease letters and they are still calling my place of employment. I also turned them over to the AG when they first started calling me back in April. The AG's office sent me a letter telilng me that they are going to look into the situation. Payday Loan Yes has a website that you can email to their "complaint" email. When I did, they never got back to me. Gee, I wonder why?

keep filing AG complaints,look into other actions.you have rights ,even if it takes an attorney to exercise them.if you know what i mean.
