Child support turned over to creditor?

My boyfriend was informed by his work that they received a 'wage garnishment' request in regards to his back child support.

After speaking a little more with my boyfriend, I find out that his debt owed was turned over to a collections agency and the request is from the collection agency.

First and foremost, I asked him to ask his HR person if the letter was specifically requested a wage garnishment or if it was merely a wage assignment, as it all smells REALLY fishy to me...

(Not to mention that this is all VERY ill-timed, as the child in question will be living with us full time permanently in less than two months time and the child's mother was working on granting full custody to my boyfriend.)

Your boyfriend may wish to speak with the case worker that is handling the child support. This probably has been filed through family court if I understand child support but there may be a contact person that is handling it.

Collection agency + past due child support = garnishment. Smells fine to me.

I disagree....

think about this--the only way to get a child support order is through the court. th court also has to be involved for wage garnishment....so why would they need to use a CA?

I would check with your case worker ASAP on this one, just to make sure that they een sent it to a CA. Especially since the timing issue you mentioned doesnt fit at all.

Outsourcing.
Wage garnishment is an administrative function; I'm pretty sure that a judgment already exists, all the CA needs to do is file the appropriate paperwork and pay the required fee (if applicable).

right, but since there is a case worker and an agency that handles child support already in place and involved, why would they pay a CA to do that when they already have the court involved in the first place? That just sounds off to me....it is as simple as sending a letter to the court for them, I dont see why they would go through more effort to hire someone else to do that and then have to pay that someone else for it. I have never heard of a debt collector for child support.

Did anyone else notice that this is for BACK child support? Having the child come to live with you isnt going to forgive what you are already behind on.

the only child support collection agency info I found doing a quick search was for companies that help the custodial parent--these arent places that would be hired by a child support enforcement office. They are hired by the parent that is owed the child support payments. Thats something else to consider...and another reason why you should be asking a lot of questions abotu this
