Hey All,
Thank you for the excellent advise that I have been given on this website. All the members are great.
I am getting ready to send out the Dv letter to LVNV funding today but wanted to clarify something about the letter.
As per the FDCPA, what is required in their response? I have seen multiple Dv letter floating around and want to make sure what I am requesting is something that they must prove. Here is a quick sample of what I am wondering about:
What the money you say I owe is for;
Explain and show me how you calculated what you say I owe;
Provide me with copies of any papers that show I agreed to pay what you say I owe;
Provide a verification or copy of any judgment if applicable;
Identify the original creditor;
Prove the Statute of Limitations has not expired on this account
Show me that you are licensed to collect in my state
Provide me with your license numbers and Registered Agent
Do they really need to answer all of these questions in the validatin letter per the FDCPA law?

everything but the proof of judgement and the SOL are things you should ask for.if the debt is past SOL you should just state so.LVNV is notorious for sending phony letters of judgement.best to check with your court clerk on that.all else you can request in your DV letter.

thank you for the reply. I have one more question. I would like to know where to send the DV letter for LVNV funding LLC. I see on my credit report that it states the address as P.O. Box 740281 Houston TX. 77274 but have noticed a different mailing address on this site. To what Address should I send the letter to?

i would go with address on this site.it is hit or miss sending DV letters to p.o. box.especially ones with a return receipt.

Just an update on LVNV Funding. I contacted a lawyer today that specialisis in Debt Law and he asked that I send him all relevant information that I have to him. I faxed over 15 pages with my credit report, the letters I have received from them and sent along with an explaination of how they are changing the collectors around. I am waiting to hear back from him. I did notice that besides the original ding to my report that LVNV put there, there has been 2 hard inquiries on my report from their associate companies. Can they keep dinging my credit by passing it around to their various partners and doing hard inquiries? this is really getting depressing to try and pay off my over due accounts and see my score go down because these people don't want to validate anything.

The Debt attorney asked me if I thought the debt was mine and I told him that the original one from HSBC was mine and I haven't heard a thing back from him so I guess that is what you get for a free consultation. I haven't hear anything from LVNV funding as of yet.

I have read this entire thread and these are some of the fears I have. I am ready to start working to settle after 2 years and a few months without paying any creditors. I have recieved 2 offers one 70%(inflated ballance) and one for 40% (correct ballance) and I countered with 15% with letters. After reading all this I think I will wait for thier responses and send in a Debt verafication letter. I don't think they will bite on my offer anyway, but if they do I will do the DV anyway to ensure thier rights to collect.

I received the green card back from LVNV funding yesterday as it had to be forwarded from my old address and it had been signed for. Waiting to hear something from them to ensure they can collect and then I can start settling with them.

Hi all,
I still haven't heard back from LVNV Funding but today I received a 3 calls from 866-890-1644 all within a hours time. I am at work so was unable to take the calls but after looking up the phone number, it appears to belong to a Richard J. Boudreau & Associates. As this is the only debt that I haven't started settling with, I can only assume it is why they are calling me. They have not left a message not have they called again since the last call in the morning.
Any advice on if I should answer the phone and talk to them or wait until I receive something from them in the mail. Has anyone had any luck when they have spoken with them? From what I have seen in this forum and on the internet, they are vicious collectors. All I want is for someone to validate the debt so I can start paying. Seems like that is too much to ask of LVNV Funding.
Any help is appreciated.

i would send them the same DV letter.as usual send i certified mail return receipt.the address

Sub: Contact with Ricard J. Boudreau Finally

On 12/29/09 I was able to take the call from the Law offices of Richard J. Boudreau and Assoc. The guy I spoke said that he was calling from the law office and wanted to know how I wanted to pay my HSBC account off. I said that I didn't know who this law office was and he said that they were working for LVNV Funding attempting to collect on the HSBC debt. He asked if I had ever had a CC from HSBC and I told him yes, I had. He asked how I wanted to pay it and I told him that I had never heard of them before answering the phone. He asked if I had received their letter and I told him no, I had not received anything from them. He said that they would send it out that day and would be expecting a call from me once it was received. He verified my mailing address and name.
Jump forward to today. I still have not received a letter from them but did get a call on my cell. I wasn't able to answer it but wanted to know if I should send a DV letter or wait until I get a letter from them before I send it out, CMRRR.
I am in Calif. and I know they are located in NH.
Any help would be appreciated.

the address i gave is good send the DV letter asap.yes send it certified mail return receipt.none of these places seem to want to collect the right way so make them prove they have legal right to collect.
