I recieved a summons to court a couple of days ago. Midland is suing me for a little over 800$. They say I opened a acount with "Associates" and said I promised to make monthly payments as specified in the "charge agreement". They have a "exhibit" wich stated a old credit card I had but can't remember from who and they don't state who it was with. They only use the term "Associates". They go on to list my owed balance was 800$ on 4/30/01. I live in Illinois and the SOL is 5 years for "open acounts" and 10 years for "written contracts". I've been getting conflicting reports of what a credit card debt is. I've read from this website (sorry they won't let me past a lilink, webite sites the truth in lending aact saying ALL credit cards are open accounts) and many others that all credit cards are open accounts. While this website (illinois legal aide)
states that most bank credit cards are written contracts. I spoke very briefly to a over worked lawyer for non profit law firm that also said that credit cards are written contracts. So I'm a little confused. If it's a open account it's past the SOL but if it's written it's 10 years in my state.

This was my first CC and was only 18 or 19 at the time. I've lived with the black mark but relized that in a year or two the black marks I had on my credit report would be gone (it's been almost 7 years) so I just didn't deal with these scumbag deabt collectors. Now I guess I need to. I got my free credit report from one of the CB. Midland reported I owe them a little over 1000$. Date reported is 5/2007 and under type of account it reads Open. Date opened is N/A and just about everything else is as well. Except for the "High credit"

So are they trying to re-age this? What should I do? In the summons it doesn't mention if it is small claims court or not. How can I show the court this is a open account and is past the SOL? They state my final statement was on 4/30/01 and the amount. Should I file a motion for dicovery and ask for my past statements and what else? Should I do a DV even though it hasn't been 7 years and my court date is about 30 days away? How do I show that the Truth-in-Lending Act covers this credit card as a open account and not as a written contract. Can I use a credit report as evidence that it's a "open" account? Any type of help would be great. I'd like to be prepared for my court date in a month or so.

this midland company has been harassing me for six years and i just called them and the saleman said that i need to file an police report and there wasn't any thing they could do about the charge. what should i do ?

Ask Midland Credit to validate your debt account. They must follow the fdcpa laws and give you accurate information on your account before doing collections. Report them to your state attorney general's office for violating the laws and doing harassment.

I just received a letter--their wording "Settlement Opportunity". They are saying it is from my Capitol One Account. I do not, nor have I ever, had an account w/Capitol One. How do I find out if this is legite? I am very leery to give them any information or even to send a registered letter to dispute the debt (dont' trust them w/my signature). What is the best way to go about this? I'm going to check my credit report. I'm getting nervous that someone has stolen my identity.

As with a lot of other people on here I have something on my credit report from MCM. I ran my credit in Jan of this year and it wasnt on there, but i am currently trying to enlist in the US Air Force and the recruiter said there is an unpaid balance on my record and they have instructed me to take care of it before i can enlist. I had a Verizon Visa card years ago that I could no longer afford to pay and it shows as charged off on my report. I owed them a little over $4k. The amount MCM has listed that i owe is $5700. I have not been contacted by anyone in a long time (never by MCM) about any of this and not sure what i need to do. I am located in TX if anyone could help guide me it would be much appreciated!

I just received one as well and I am a collector by trade. An agency will submit to you a copy of what is owed and give you details so you can either pay it or dispute it when you write to them asking what this is for. Never do they ask you to send your documents first. Mine sounds like a scam where they are trying to get my account info etc.. because I have never owed mci communications any money -- in fact they had a scam before they went bankrupt a while back. And it is also funny how my neighbors all have received the same letter and never even had mci communications as they claim they owe in the letter. There are alot of scams out there trying any way to get your info or money and I am referring this to the attorney general and doing my own research. Because they actually at the time went belly up and owed me money and that was over 10 years ago when I even had them. Be very careful to give out any of your info.

My husband and I recently applied for a mortgage and the only thing in our way is MCM. This is one account listed several times on the report. The dates are different with the different CRAs. The account lists as open, even though the original creditor account was closed prior to having even 1 late payment. We stopped paying the original creditor (Household Finance Corp) when our balance was going up even though the account was closed and all payments were made as scheduled. We asked for account history or copies of statements which they could not produce. We believe the original debt was paid. HFC stopped collections and there was no immediate negative reported. A year or 2 later, we heard from a CA, asked for validation, which they couldn't produce and it went away. Then it came back with another CA. Same inquiry and result. Then Midland who "can't locate" us when I request validation even though contact info hasn't changed and then they list again as open with new date. How do I make it go away rather than just reappearing? Original creditor has no info. I have disputed with CRAs, but it comes off and then back as a new account.

I received a letter today from Midland. They are requesting payment for a Citibank debt. As far as I know, all my credit card debt from the past 20+ years is current or paid in full. Also, the name they sent this letter to was from when I was married to my first husband; that marriage ended in 1985! I am already working on requesting the information you suggest but is there anything else I should be aware of? I have not been legally known by this name in more than 22 years! Thanks.

Okay, so here is my scoop, I got a call in June from MCM indicating that I had a bill with them for a credit card in 2001 and they would settle with me for $440.00. I asked what the credit card was as I havent had a credit card since 1994 I believe it was. They gave me some name that I no longer remember. I assumed this was from a past Identity theft that I have been left paying for. This original identity theft began when I was but 14 years old. Had someone go to college on me, the whole works. I had to pay their student loan before I myself could go to college. So, at this point in my life 23 years into living with this identity theft, when the creditors call me, I pay, I gave up fighting it. At one point probably 10 plus years ago I went to get an ID card and none of the information or the picture matched me, so I called the police filed a report. Finally I had proof of the identity theft! This did me no good at all and I am still paying for previous identity theft. So when MCM called me I made payment arrangements. One payment of 100 dollars and one payment of 340 dollars. Then I got a call a week ago from MCM telling me that I have several thousand dollars in collections with them, from credit cards and that I even purchased my credit report using the card. I have only ever gotten the free annual credit report. I was shocked that whoever was stealing my identity 23 years ago apparently is still doing that and even made some payments on the credit card. Okay, so at this point in my life I just cant pay anymore of these bills that I didnt acquire. MCM of course wants more money from me and so does some other Arrow Financial management company. I just went and pulled my three free credit reports and Midland and Arrow are both saying that these are accounts opened in July of 2007. Even though these accounts were originally in 2001. I live in New Mexico but these were originally reported from when I lived in Alaska, so which SOL apply? New Mexico or Alaska?

Thankfully much of the negative stuff has fallen off my credit reports. But now with Arrow and Midland reporting these 2001 accounts as new and past due as of Jul 2007 I dont know what to do. I know I need to have them validate, but I need help writing a letter.
