I have received a letter from Midlan Credit Management for an amount that 2 months ago was at $897.56. Now it is at $1,495.94 How can this be? The initial bill due was $400. What can I do about this? Can they charge me this much money for a $400 bill?

I recently received a so-called "settlement opportunity" from MCM on an account from Citibank USA. I called Citibank, provided the account number and my SSN to verify the validity and they have no record of such an account. My next step will be to contact MCM in writing and I would like to use the letter posted on Nov 16 for "RM" as my baseline to request the information from this hack organization. As two years have gone by since that letter was drafted does it still apply today or have elements of the Fair Debt Collections Act changed. Thank you in advance for any insite you can provide.

Hi,
Got a call last night from mcm demanding payment for a verizon cell phone that I had a few years back that was lost. I called verizon requested that the cell phone be switch off or whatever they do so that no calls could be made. I received a $600 bill about a week or so later with all these calls on my bill. i disputed the amount. Verizon said all I would have to pay would be the last month bll and the cancellation fee which was around $250. But my circumstances change and my Visa expired so I went back to the UK. Thinking that i would not be back in America again. But I came back almost a year later. I had forgot about the bill. Any documentation was threw away when I 1st left. since i came back i have gotten married and am about to become a father. anyway MCM called me last night sayin the bill is now over $1000. What can I do?

Hi Wayne, welcome to the forum. First of all u need to send them a debt validation letter which u can find in the do it yourself section of this forum. Make sure to change it to fit ur situation and send it return reciept requested.
That's your start, i'd also send a cease and desist letter in with ur debt validation.

(This is my third try to post this... Third time is a charm?)

They can and do violate the laws. I'm getting harrassing calls from Midland MCM while they are trying to find someone who used to have my home phone number over 10 years ago. They have now tied my personal cell phone number to their account and have repeatedly called it even after I tell them that they have got a wrong number and explained the whole thing to them. (They've called me 3 times so far. Fri, Mon, and Tues.) Each time I have told them who I am and have asked them to stop calling me.

Here's an excerpt of my last phone call: (At the end of this call, I'm starting to get a little PO'd)

Tuesday morning at 9:18AM : My cell phone rings, so I answer it. They ask for "Richard". I tell them to "wait a minute", (while I went to get something to write with and a piece of paper), and then I asked "Who was calling."

He said: "Is this Richard?"
I said again: "Who is calling".

At that time he said his name was "Chris from Midland MCM", and asked again if he was talking with Richard. (You could tell from the accent that the "Chris" was from India, and I'D bet that his real name isn't Chris.)

I told him that I am ***** ********, and this is the third time that you guys have called me asking for Richard *********.

Anyway, he snapped back at me: "Why didn't you tell me that you were not Richard?" "Are you deaf or something?" "I was asking for Richard".

I said: "I told your (f---ing) company the past two times that they have a wrong number and to quit calling my cell phone but it didn't make a difference because you keep on calling." I then asked for the manager or a phone number to call him back with. (As you can tell, I was getting a little upset at this guy for not only acting like an ass, but I realized that he's eating up my minutes on my cell phone.)

He said that I could not talk with the manager and that I should use the number on my caller ID to call him back with.

I told him that the caller ID on my cell phone didn't list his number. (Evidently his company is blocking the outgoing number)

He said: "You don't have my number?"

I said: "No"

He said: "Well then I'll call you back tomorrow" and hung up on me.


I was literally furious at that moment in time and ready to kick someone's butt. For the most part I am very patient and laid back type of guy, but the disrespect that "Chris" from "Midland MCM" showed to me this morning has me wanting to seek damages.

I don't know. I thought the burden of Validation was their responsibility, not yours. Isn't this correct?? Anyone know?

Without a letter of intent, my payroll has been deducted 25%. I had established payment 6 month payment plan with midland in 2006. It 2007 and not one phone call, nor letter have I received concerning payroll deduction.
This web site of concerns was a great light into what I should do to clear this issue. Since it is the weekend and I am teaching classes until 4pm, the worry over the weekend after reviewing this site will not be too bad. The addresses, and phone numbers listed will be the first things I use on Monday morning to clear this issue. Not once have they offer a settlement before garnishment. What have they done with the payment received in 2006? The $1,000 settlement offer should have come to pay for interest. Since the card was only 600.00 before apr and late fees and now attorney fees and court cost and God Know what who else I'm paying.

i recently started recieving phone calls from Enhanced Recovery Corporation, stating i owed them money,naive that i am when they asked for my DOB my SSN and my address i gave it to them. when they started asking for my employment is when i started asking questions about the matter of the phone call and asked for info in writing, at first they refused and asked for financial info! I told them i had no bank account they said I was lying and demanded i gave them the info, when i didn't he passed the phone over to his "supervisor" who was even more aggressive. I checked my credit report and come to find midland credit management for the same amount owed, but not Enhanced Recovery Corporation on my report. i have never heard of either. and my credit score has dropped about 80 points in the last 2 weeks. i was hoping to buy my first home and now with my credit score being reduced i dont see it happening in the near future, what do i do.

Hi Krystal

You have to send a validation letter to midland credit management notifying them that under FCRA they have to validate the debt and if they do not respond to your letter then you will be forced to take legal actions against them.

You can also send a dispute letter to the CRA and enclose all the copies of the documents that support your position.

These guys are annoying, I recently put in a phone line. I had to put it under a friends name who unfortunately had debts to pay and one day later, these guys are calling me early morning, late evening, saturdays, sundays. I have never given this number out to anybody. Crazy I tell ya. I told them he doesn't reside here, yet they constantly call. One guys even thought I was him !!!

Send them a cease communications letter, state that the person does not reside there and that you wish to have no communications with them via telephone nor written. Send it certified mail, return receipt requested. Save the signature card you get back as it will be your proof that they had received it.

I received a letter from MCM stating that I owed Citibank, and they would discount the amt by 50%. I paid this offf years ago
and do not have the files anylonger. What is the SOL in calif? This debt has not come up on my last 2 credit reports. I will send the validation request letter.
Should I do anything more??

California Statutes of Limitation

Written agreements: 4 years, calculated from the date of breach.

Oral agreements: 2 years.

The statute of limitation is stopped only if the debtor makes a payment on the account after the expiration of the applicable limitations period.
