first off, I would like to thank you all for giving out advice and be so willing to help one another out. I am grateful for this site and it makes me feel more confident about getting out of debt.

so this is my story. I am in the process of paying off all my debts. I have made payment arangements on all except for one. I have one debt from bank one that was $700 originally. Now a collection agency called Unifund is collecting for them, it is now at 1320. I have not recieved anything in writing from Unifund and I do know for sure that this is a valid debt. I have recieved phonecalls though. I can afford to pay this off in 4 payments but I have heard horror stories about dealing with them.

They have a website which i have looked at, and they claim they make it easy on people to pay in installments, that doesnt seem like the truth from what i have read.I would like to get something in writing from them about what i owe, so i was going to send them a debt validation letter but I have read from some people that they will refuse to accept letters!

So what how do i go about working this out? My one option was to wait until i have the whole amount and just send it to them. But then i wont have anything in writing saying that its the right amount except for my credit report, Im not sure if that is enough proof in case this comes back to haunt me. I know they are one of the worst debt collectors out there and I dont know how to handle this. any help would be much appreciated.

You should send them a debt validation letter anyway and send it certified mail so you have proof you sent it. They are required to send you something in writing once you request it. If they don't send you the validation you can file a complaint with your Attorney Generals office and also the Attorney Generals office of the state they are in. I wouldn't send them anything until you get the debt validated.

By law they are required to send you something in writing within 5 days after initial communication with them which appears you have already had.

I would definitely send them out a dv letter, you can find samples of them in the do it yourself section here if you dont know what one looks like.

As for the cr information being enough to come back and haunt you I would definitely say NO. Many collectors hit a persons report for no legitimate reason. The burden of proof is on them to prove they have a reason to be on it.

When and if they provide proper proof, possibly by that time you may have saved enough to pif or possibly settle for less.

thanks for the information.

I decided to call them and i found out my account is no longer with them. its with a company called First Resolutions Management Corporation. I have a credit report from two weeks ago and it doesnt have them listed so I guess they just passed it to them. I called them and they said they didnt have my records, its probably not in the database and to call back in one week.

I have not recieved a letter from them but I should be anticipating one correct? Now im even more worried Crying or Very sad

When they get it, you turn right around & send them a *validation letter* certified, registered US mail
