Default can debt collector garnish wage in pa credit cards

:cry: i have been paying on my credit card every month with focus on my account. i told the rep that i only have 100.00 to pay a month at first they told me i have to pay 257.00 before they would except the 100 dollars a month.so i sent in the 257.00 and up until last week they called and told me i need to send them 250.00 for the next two weeks whick i have to give them 500.00 on this acct or they will garnish my wages. they have called my job twice, a company beford this company threatened my father in so many words a guy from erc told me that the company would just wait until my dad dies and then they will get their money. i have been trying to pay on this acct.

Who is the credit card company you are dealing with? Is it the original credit card issuer, or has this gone to collections?

In the state of Pennsylvania you CAN NOT be garnished for consumer debts.

They can't garnish ur wages unless they get a judgement on u first! And some states dont' even allow garnishments!
Send a cease and desist letter immediately! Make sure u send it return receipt or they may just make paper airplanes outta it! ha ha (ooppps sorry, not trying to make light of ur situation, i totally understand, it's just another post i was referring too)

Don't worry..Pa DOES NOT allow consumer debt garnishments...Period. No matter what the circumstances.

Just be careful. I was told by a lawyer in PA that they can freeze your bank accounts. They are not allowed to threaten to do anything that is not within the laws of PA. (i.e. garnish wages) The comment about your father, I would turn that into the authorities.

Only under very limited circumstances does Pennsylvania law permit the garnishment of wages. Garnishment of wages is a seizure of wages while they are still in the control of the employer, and have not yet been paid out to the employee. An employee's wages, salaries and commissions may be taken from an employer through appropriate legal procedures to satisfy five kinds of debts:

1. judgments for child or spousal support
2. PHEAA student loans
3. room and board for four weeks or less
4. back rent on a residential lease
5. obligations relating to final divorce distribution

Garnishment of wages can be accomplished only by a court order directed to the employer and no such court order can be issued without fair notice to the debtor/wage earner. Other than the kinds of debt listed above, no other debt or legal obligation can give rise to wage attachment in Pennsylvania

EXACTLY..Non consumer debts can't be garnished. BUT, yes they can freeze bank accounts. Although I would think it would be highly doubtful and VERY expensive for them to seize an account due to a CC debt. You definitely need to report this clown's comment about your Dad. That is disgusting.

What if you travel for work My home residence and address is in PA but I am paid from companies outside of the state of PA. Can they garnish those wages?

I do not believe so--the law applies to residents of PA, it isnt directed at where your company is from. Many people work for a large company, and they may live in one state, but their checks are processed by the company's HQ in another state. I work for a company right now that is based in another state, so a check sent by mail will come from outside my state. Makes no difference because I am a resident here. I dont see why your laws would be any different up there.

All Federal student loans can garnish it the state of PA, not just PHEAA.

I live in PA, too (as most of you know). I DIN'T know you can't have anything garnished. WHEW!! That's actually a relief to me..trying to deal with some of these people is crazy! I'm curious....I've seen alot of NEW posts for Cash Call. People have PMed me and asked if they garnish wages...no matter state they live in. Anyone have an answer? ALSO..wanna say..HI WULF!!
