Hi I need some advice, I received a call from a Delanore, Kemper & Associates regarding a payday loan we had with Apple Fast Cash. They have threatened to file charges of check fraud against my husband because we had closed our account and went into debt consolidation. The loan was for $600 and we have paid them $300 already directly to Apple Fast and now this Delare place is trying to collect $1000 from us and threatening us. She called me again today and said they were filing a deposition, this place is in georgia. Any one have any information, I've been told they can't do this and it's just a scare tacticks. Pay day loans are a civil matter not criminal. Read the pay day loan forum.

I have a client I quoted a Kemper home policy and this is one of the questions she had. I could locate one for 2005 and nothing more recent. Do you have anything more recent

ive been having a pay day loan calling me for 3+ years and my family memebers, theyve went so far as to act like an officer of the law and said I had fraud charges lol...they practically break the law to try and get their monies. I was in same situation, took out a couple payday loans, then closed my bank account because they were taking payments out automatically and overdrawing my account....Its just scare tactics I believe. If I were accused in court I would be in jail by now.

I am being threatened by some people that have american names but speak with an accent that is Indian or some kind of asian they are telling me that I borrowed money from a payday loan company that I do not reconize. I have borrowed before from payday loans but not this company. They have threatened me with internet fraud , check fraud,and something else. The only payday loans I have taken out have been paid via withdrawal from my checking acct the number that has been calling is 3109078040 the number shows up as unavailable and the man that answers sounds Indian and given an american name

the no says it is based out of southern California but really they can use a switch board and use a number which is based here in america to call people in the states.

REPORT THEM TO THE LOCAL, STATE AND FEDERAL AGENCIES.

What happens is after a debt goes uncollected for 3+ years, it is often bought up by these less than reputable collection agencies. They have no legal authority to collect the debt, so they often use intimidation to get you to pay. A very common scam is to scare people by threatening to charge them with "check fraud". This is illegal and a violation of the

You need to record these calls and safe any voice mails from them. I had a payday loan debt collector try and collect from me after 3 years and he threatened to have me prosecuted for "check fraud".

He was also dumb enough to leave a voice mail on my cell stating that he was going to "start proceedings" against me for check fraud. Under no circumstances should you give these people a dime, ever. Chances are they have tacked on outrageous interest charges and other bogus fees, and will try to extract two to three times the amount of the original debt from you.

Get a consumer rights attorney and sue the company. Most consumer rights attorneys will work on a contingency basis, and if you lose, they don't get paid. 99.9% of the time, the debt collection agency will settle in 2-3 months and will not go to court. You are only allowed $1000 in damages, but most often the debt will be erased as well as part of the settlement. So, your attorney fees will be paid, the debt will cleared, and you will put $1000 in your pocket.

Remember that just because you owe money to someone does not mean that you don't have rights.

ALWAYS do your due diligence before you open your checkbook for these people.
