I sent Unifund a VOD letter and now I get this!!!!

A month and a week later I get a letter from them demanding payment again or they will file suit against me. They had no response to my Validation letter at all!

What do I do now? Am I a sitting duck?

Unifund is that about a student loan? Just curious I think I have dealt with them in the past. Hang in there and someone will be along to provide more guidance.

If this is a student loan is it a federal loan or a private lender? Makes a big difference in how to handle things also, as far as contacts etc.

It is not for a student loan but for a at&t visa card I had 2 years ago.

They are located in Cincinnati OH.

Well, that is continued collection activity and is a violation...they are supposed to cease all collection attempts until they provide the validation. You should send them another validation letter pointing out that attempting to collect after a validation demand has been made is a direct violation. Then once more demand validation. Also keep that threat letter and when 30 days are up you can also use the fact the threat of suit was just that, a threat...that is a violation as well if they threaten to file suit and don't follow through.

Even IF they do file suit, you can use these letters as a defense, stating that you made a validation demand and they violated the law by continuing to attempt collection on a disputed debt.

Make sure you send the letters certified mail and require a signed receipt. You will need this proof that the DV was received.
