Hi All,
I have a situation. Palisades Collection, LLC has been contacting me for the last few months about some mystery debt I owe to ATT Wireless. Based on some advice (from this forum) I sent them a letter to verify my debt. A few weeks after that letter they removed their entry from my CR. A few months later they sent me a bunch of papers that look like a bill from ATT and I now see a new entry on my credit report for a derogatory acct. The "bill" that they sent me looks nothing like an ATT wireless bill, but rather something that they created themselves, BUT it has phone records on the bill that I recognize. I attempted to contact ATT (formally cingular)and they told me that they cannot go into their old system and pull up my records AT ALL. "The system has been removed". If I can't get any proof from ATT then how do I get rid of this collection agency. It's my word against theirs! Please HELP!!

Thanks,
Steve

I would be real suspicious of this...if AT&T doesn't have these records then how did Palisades get them? They definitely sound phony to me! I would mail them back another DV, a very stern letter and inform them that what they have provided is forgeries since AT&T has no record. I would demand they remove that derogatory item immediately or face a lawsuit.

Hmm can you get AT&T to send you a letter stating they have no such files? If they won't send them, try sending AT&T a polite letter asking for a copy of this file..then at least they would send a letter stating there is no such file and you have palisades by the er...jewels.

Thanks for the reply goldenblast. The interesting thing about this case is that the reason ATT can't provide me with sufficient evidence is because when they sold the wireless business to Cingular and then bought it back, the old system was taken offline and became no longer available. Is it possible that palisades received this info before the system was "taken offline"??? Even if they did, there's no way for me to prove this debt is not mine. I will contact AT&T like you said and see if i can get a letter from them. Thanks again!

The wonderful thing is..it is not up to you to prove the debt is not yours, but it is up to the CA to prove the debt IS yours! All of the burden is upon them. Demand they validate this supposed debt, demand to be shown paperwork from AT&T itself and not some regurgitated rubbish from their own files. This is your right and it is their responsibility. Do not let them intimidate you.

And a meat grinder!!! (Did I say that out loud?)
I wouldn't worry too much, Steve, about them being able to prove that it is your debt without accurate records from ATT but I would make demands to have it removed from the credit report. It isn't fair for them to damage your credit without any grounds to stand on. Good luck!

You said that the origional poster would have them by the jewels, so I ask if anyone has a gem cutter, it's basically a diamond tipped dremmel tool used to cut and polish precious stones, heh stones... that too...

And a meat grinder to grind the jewels into pulp

But to never feed to anything that we love! All of that rotten meat would make your dogs sick!

Hi

I have heard some really bad stories about Pallisades....they are crooks. I agree with goldenbast.. we should not let them intimidate us....we must exrcise our rights against them.....we must make complaints to the state general's attorney office, BBB and FTC

Take care
Nelly

Speaking of Palliades, here is a couple of interesting websites for you:
westerncapitalturnaround.com
mycollector.com
These websites are run by Robert Paisola. Mr. Paisola owns Western Capital, which is a collection agency that only collects on business accounts, he refuses to take consumer accounts. He also (for a fee) acts as a consumer advocate and does a confrence call (recorded if applicable) with the CA and ends up revealing his presence when things go south. His calls with allied interstate are the most interesting.

Palisades is out to make money...end of story. They tried to get me to pay for two verizon accounts that were supposedly active with the same account number, phone number, billing period, and address. If you ask for copies of their documentation from the phone companies you will notice that the balance due has a different find type and size. Send this into the fraud department of the credit bureaus and indicate in your letter that the documentation is altered form the original billers. This will take care of it.
