Disputing debt with Bank of America & NCO Financial

Has anyone had any luck disputing a debt with Bank of America or NCO Financial? Also, how long does it take to hear on whether the debt will be dismissed or if I will have to continue to pay it?

I had a bank account that I closed in January of last year. Well because I had 2 pdl's that kept trying to take money out of my account even though I had been making payments to them with payment agreements, BofA didn't close my account until April. So now I have $900 that I owe them only in overdraft fees. BofA didn't pay anyone a dime out of my account.

I met with a local Bank officer who told me to dispute the debt since it was all overdraft fees. She said that's what she would do.

If a bank officer told you to dispute the debt,that's what I would do.You also need to get a complete debt validation from NCO(good Luck) on payment made,etc.I would go back to that bank officer and have her walk you through the process.Keep us posted...Karen Very Happy

That's what your move should be, SHbear. Dispute the debt with the bank. They will verify your records and correct it.

Since you already have the arrangements with your payday loan company, find out the purpose of NCO in writing. Perhaps, through debt validation procedure

Just because you get an overdraft fee doesn't mean they paid out. You get fee's from BoA for each attempt that someone tried to withdraw funds from your account if the funds are avaliable. Let me restate this. For Each Attempt you got a charge every time they tried to clear funds that weren't avaliable. It's called a NSF fee.

Because PDL's do these as Auto-mated Clearning House transactions they are difficult to stop. I myself had to pay over 300 dollars out to my bank before I had them put a freeze on my account for all incoming transactions. I described the activity to them as fradulent because the PDL company refused to let me pay 1/2 of the loan one day and the other 1/2 5 days later. SO I made my account inaccesable to them.

However I was held responsible for the NSF fee's because of the agreements we sign with a bank when opening an account. I paid them then reopened my account which I made sure had restricted access. A duplicate check can not be withdrawn from my account nor an ACH withdraw unless I notify them that I authorized one.

SHbear said that he/she closed the BofA account in January. BofA didn't close her account until April. (I am assuming that there he/she has proof of the request done to close the account in January)

Is he/she still responsible to pay the overdraft even after the account was supposed to be closed?

BoA will not close accounts if you still owe money. BoA is a complete jerk and a total rip off to anyone who happens to be down on their luck.

What you should have done and I know this doesn't help now was to put a freeze onto the account. I would suggest you deal with BoA directly and see if they will dismiss some of the fee's agreeing that you will pay a portion of them.

I have disputed a similar situation with BofA (not PDLS, but they kept paying charges put through by Prodigy Internet even though there was no money in my account, and they and prodigy were told to stop and I told them I wanted the account closed. They turned it over to some collections attorney, can't remember who. I disputed it with them and it took LOTS and lots of phone calls and faxes. You will not get anywhere with the front line people or the CSR's on their 800 number. I ended up talking to some guy in some office in Las Vegas. He was VERY helpful, and really went above and beyond the call of duty ( even calling me on his cell phone from his sisters wedding on a Saturday) When it was all said and done it took about 6 months for them to sort everything out, but when it was over they ended up reversing all their fees, all the charges that shouldn't have been paid, and gave me a $50 AMEX gift check for the inconvenience. IT does take a while,and you you have to find someone willing to listen and do the research. AS for NCO, based n their reputation, they probably wont do jack for you.

I do have documents that prove I closed the account in January 2005. We tried to deal directly with BofA regarding the fees, however we were told that since was sent out to collections, we have to deal with NCO. LCW, I will definitely keep fighting this until hopefully I can have them reverse the fees. The bank officer was very helpful and said just keep trying. How long does it take to hear back from BofA initially you dispute a debt with them through their CA?

Once you work your way through the layers, they work pretty fast. It's getting to the people who can and will actually check into things for you that takes time.

It's not only these pdl's that are sending racking up the overdraft charges. Walmart here now sends a check through as many times as it takes untill they get their money from the bank. My mom has had as many as 5 tries from walmart on the same check. She finally called and told them as long as they keep trying to send it through they won't get the money cause when she deposits any it's just going to go straight to od charges. I don't know if they can do that legally either but you will find many companies who believe since they are so big they don't have to abide by anything but what they want.

WalMart is switching to a electronic presentment system which works basically like a debit card. If you write a check at wally world today, they get an approval for electronic withdraw,and the amount is immediately debited out of your account. Not all stores are on this system yet. The stores in Iowa are, stores in Chicago are not (yet). I'm pretty sure its just a matter of time until they all get on this new system.

I had a check written to another merchant a few months ago get presented and returned twice, when I called the bank about it (it ended up being a error on their part), they said the merchant can re-deposit as many times as they want, but the banks policy was to mark the Item "Do Not REDEPOSIT" after the third attempt.

call the 800 number you were provided with and request the account to be placed in a Dispute status giving you a 30 day head start on finding out how to get to every one else, there is a chance that this was reported to the credit bureau, so the best thing is to definitely get it statused as a dispute

LCW is right,when I worked at a bank years ago that's what they did. I was in the check return department,and after the third try,they could not present the same check again. Wally world here has already gone to the electronic debit... Karen
