Here is the story. My husband owes money on a school loan that is nearly 9 years old now...Besides the point, but it gives you a frame of reference for how long we have been contacted about this matter...

So anyways, this MRS associates called MY parents house and MY father's business about my husband's account. My parents gave me the number and I called to tell them not to call anymore and to get the address to write it so they can't contact via phone anywhere any longer. The "associate" asked for the phone number they called and then asked if it was about Chad Maynard(I never said ANYTHING to them except the number). So I said yes, then he proceeds to say, "So what are you going to do about it? You know we are getting ready to sue for the $33,000 on the one loan, so are you going to make good on it?" He gave me ALL the personal info, including the account number and everything!

The problem here is that I NEVER gave him any info about me, no verification of who I was, no social, no address match, I am a woman(and it is MR. they were calling for) and he even asked who "<name>" was, and the name on the id which is NOT the same as my husband's last name, not even CLOSE!

So as I proceeded to tell him that what they had just done wass illegal, a supervisor got on the phone to say that I illegally identified mySELF as my husband and I was the one in trouble...do they really believe that? Then I accidentally hit transfer and they thought I hung up..when I went back, the supervisor was on the phone yelling at the "associate" saying that he couldn't give out that kind of personal information without verification...

So what kind of recourse do I have? They must have mentioned 30 times that the call was recorded so it could be subpoenad in court...should I go after them for divulging info illegally? (We live in NH if that makes a difference)

You could sue them over it, during discovery you could do a subpoena for the recording.

My lawyer kicked MRS's ass. They repeatedly called me on my mom's debt. I used the money my lawyer got from them to help pay for my first car. Thanks MRS, you stupid F'ers!

You should also file a complaint with your state Attorney General's office and speak with a attorney of your own to discuss the possibility of a civil suit. If you need help locating a consumer attorney in your area you you can start with naca.net

Star keeping a well documented log of such calls, and if legal in your area, record them. 16 in Texas has the right idea. Make them pay (literally) for their stupidity.
